I have received an opportunity for a job in NYC, probably only a 6 month contract.

Now, I will need to head over to get an apartment first hand, which I assume I will need a visiting visa? How tough will it be once over there to get that 'upgraded' to a work visa once I have the green light from said employer?

Thanks

Incredibly difficult!

If you enter under the VWP, this, hence the name isn't a visa, so there's no route to change it to a visa.

Applying for a B2 tourist visa in your situation is extremely likely to be declined as you're coming from a VWP qualifying country, and the embassy would want to know why you need a B2, any mention of jobs and changing visas won't go down well!

So my only option at the moment is to get the employer to provide their part before me entering the US and me applying for a visa with them before hand?

If that makes sense.

You don't need a visa to go looking for the apartment - just use the VWP. Then, I'm assuming your employer will sponsor you through getting a proper working visa. I'm assuming it's just you who is going?

Unless the job is incredibly unique and only you can do it or you're transferring from a management position in the UK to a management position with the same company in the US, I wouldn't start packing your bags.

H1b Visas are incredibly over subscribed and incredibly difficult to obtain unless you have a very specialist skill!

A friend of mine has just got his working Visa through for the US, funnily enough he is moving to New York as that is where his Fiancee lives (they're getting married this Summer). It has taken just over a year for it to go through and he doesn't have anything particularly specialist to take there, all he has done is some online web design training and at the moment doesn't even have a job lined up at the moment.

If the visa is sponsored by the company or you are working for a UK company that already has presence in the US then it will be much easier than going over and doing it from the bottom up.

Okay, below is a rough rundown of the most common ways people emigrate to the US (Most of this is from memory so apologies in advance if I get the names of some visas incorrect):

CR-1 (Marriage Visa) – By far the “quickest” and “easiest type” of Visa to obtain, all you need to do is convince an American man or woman to marry you, simple, once obtained you can get a green card and work in any old job that will take you!

L1 (Company Transfer) – Probably the second “easiest” visa to obtain, work for a multinational company in the UK and get a transfer to the US, though you will need to have a fairly significant role within said company, don’t go running for a checkout job in Asda thinking you can get a transfer to Walmart.

H1-B (Temporary worker of distinguished merit and ability) – I assume this is the Visa the OP is looking at, emphasis on the distinguished merit and ability, I think the US issues around 65,000 of these a year, and they receive 300,000+ applications, essentially you need to be able to do a job that no US citizen can do.

There’s also investment/business based visa’s but these require investement of around £500k-£1m I think, and to employ a certain number of US nationals e.t.c.

How do the popstars/actors seem to work in US/Europe with impunity.

Even B-C list stars seem to head to the US for work.

I would imagine this is one area where the jobs are heavily oversubscribed.

I guess "artists" are unique, or can be argued as so.

Hold on chaps... No mention of marriage! Haha, I'm a singleton, nothing special in a job, just have one I can take if needed. I need to call the guy tonight to see if he can get a visa sorted as my employer if I take the job.

What is the job? Most wont carry visa sponsorship

In that case, and I don't mean to sound negative, but I wouldn't waste the money on an international call.

The work visa can take a fair old while. Get it sorted BEFORE you start looking for an apartment. You can rent anywhere, there will be a fair amount of choice. I don't see why you would go first without securing a work permit?

It's hard enough for those that are married to Americans to get everything arranged, let alone getting a job without doing it. I'f you have contacts for NYC, let me know!!!!
