Out of warranty replacent under EU law?

Any had any success getting a replacement from apple when a product is out of apple warranty but within the EU law warranty?

Phone microphone is borked and phone is over a year old, going to the genius bar tonight but not holding out too much hope, worth a shot though.

Any tips? :D
 
Has the phone been dropped or mistreated in a way that could cause the mic to stop working?

If not, Sales of Goods Act should cover you for this.

Nope, it's been cared for like a baby :p

You will be better off arguing under SOGA. If a fault develops within six months it is up to the retailer to prove that the goods are of satisfactory quality.

Under the EU directive 1999/44/EC the fault must be reported within the first two months of purchase to move the onus onto the retailer.

Phone is over a year old so this wont apply? Although links seems to be broken so can't tell!

Guess I'll fire off an email then leave it at that.

Contact AppleCare and Apple Customer Relations. I'd argue the point that the phone has never been mistreated, dropped, or had a dip in water, and that you can take the phone to your local Apple Store for them to verify this (water indicators). If this is found to be the case, there is little they can argue with.

A one year old phone that is sold with two year contracts should not be lasting barely over a year, full stop.
 
Well had success after my email (to tim cook).

Put through to some exec CS people who re-did a few checks and gave me a one off replacement. :)
 
Yep, they have given me an extra month warranty so it will be replaced under that.

Just the usual social engineering combined with consumer law ;)

Just email [email protected] and you will get a Senior Executive Relations call you within about 24 hours and they will sort out your issue.

I had an issue once so I sent an e-mail in, and within 24 hours, an Apple Executive relations women began tracking me down through the numbers on my account and finally got hold of me and sorted me out right there and then within about 5 minutes.

This is what I do for most companies when there is a real problem, talk to someone senior enough to make a real decision. Often shop and sales staff are not allowed to do this by the companies policy which is understandable.
