Accident - but the other party is being a nightmare.

Ill be quick with this thread just wondering whaf you guys would do.

Someone crashed into the back of my girlfriend at a roundabout. They get out but the guy was being abusive blaming my girlfriend. Which has angered me the most. Anyway they swap details and he was not happy at alll with the situation.

My girlfriend only has a Y reg Ka which is worth about 750quid really. But at the end of the day its been damaged by an idiot and needs to be repaired. She has phoned her insurance and given the guys details just for the record but ideally would rather not go through insurance. I suggested around the 240 quid mark for a scrappy bumper and fitted.

Her insurance has been trying to contact him with no avail. We have tried contacting him directly with a woman asking what was it about. Then when we explained about the crash she didnt want to know also.

So where do we stand then in a situation like this when a person does not want accept his responsibility for a crash in which was clearly his fault.

should have called the police!.

the other party crashed into the back of your girlfriend so they are to blame no matter what. her insurance will get your car fixed, don't forget to make a claim if any injuries have occurred.
also what the car i worth is irrelevant, keep pushing the insurance company and take no **** off them.
 
The best option in this scenario is to contact his insurance directly. Either that or just hand it all over to a claims management company if you get nowhere. It's just not worth the stress having to concern yourself with it.

I'm sure if any genuine injuries have occurred the OP / his GF won't need to 'remember' to pursuit. Pursuing for any other reason is fraud and this sort of conduct really shouldn't be encouraged as its a flase economy that costs us all!

Yeah thanks guys.

I told her she should have phoned the police when he was being abusive. But she only phoned me when she got tk work and told me about it. I was fuming.

Well it looks like the police are going to her tonight now anyway...
 
Be sure to make a note of the crime reference number, quote this to their insurer and wait for the other party to squirm... Good luck!
 
Ring the person who crashed into the back's insurer and explain what's happened and get them to sort it out, stuff chasing around for some cretin.
 
Yup there's no 'crime' as such, no one was hurt and no one failed to stop (well the 3rd party failed to stop before hitting the Ka, but you know what I mean :p )
 
In theory there is potential for due care but no requirements to inform the police have been met in the OPs circumstances.

To be fair, loads of driving offences could technically meet the criteria of Careless Driving, but aren't pursued. OP, not sure what you can do now you have told your insurer, but if it is a non fault accident, it is always much much easier to go to the other persons insurer directly.

As far as I can see there has been no crime committed.

OP, did the other driver produce an insurance certificate or evidence of insurance at the time? If not, the driver should have reported the accident to the police within 24 hours whereby he would be required to produce his certificate of insurance to them.

No the other party has not produced his certificate. Police visited my girlfriends house last night and said they have tried contacting him but it's going straight to answer phone. Also her insurance is in the same position and cannot contact him.

To be continued.... :)
 
Unless she caused it (started to pullout then stopped for no reason etc), my bet for him being abusive would be that he's not insured and this accident is now going to highlight it to the plod...

You should now have an "incident" reference number - my mistake calling it a "crime" reference number... Use this when notifying the insurers... :rolleyes:

That's still not her causing an accident - as a driver you should always be aware - aka even if she had stopped for no reason (or a valid reason), its the other persons responsibility to keep enough distance to be able to stop without hitting them.
