Tendering out part of the company's business to a contractor may fall under TUPE.

If the employer lies about making someone redundant, does the 2 year minimum employment requirement still stand? I know it doesn't apply in some cases, not sure about this though.

Its all very complicated.

I've just started to research after a meeting yesterday when it was discussed about my client making 22 of theyre employed drivers redundant in order to bring all of their collection over to my company.

Most of my drivers are subbies so would be very nervous about taking on employed staff especially as some of them are muppets.

This company is owned by a large PLC so I'm sure their HR department will have a better understanding than myself and most on here. But as yet they are working on what they can do.

But as its more than 20 employees the rules may be different still

Why do it now though when they might stop advertisement of the job? I would wait until whoever it is they hire is sucessful hell i would even try for an interview under a different name for badness.

Either way i would let them hire the guy then inform them of the 6 month rule and your intention to sue them to high heaven.Should sort em out :)
 
As he has been there less than a year pretty sure they can just get rid of him any time for any reason more or less without repercussions its only once you've been there a year or more you really have much clout for things like unfair dismissal.
