Background first

I put my bin out last night (as we live on a private road it has to go to the main street) mine was out and a couple of the neighbours. Our lids all closed as the council here will not take it if it is slightly up or a bag on the floor.

I have taken the odd bag to the tip myself if needed.

Went out this morning and as I looked in my rear view mirror saw a bin lid up thought it must have been someone elses.

Wife went out this morning to take them in 4 bins all had lids up red tags on them saying bin lid open not taking.

1 house in the street has managed to go about 5 bags over there green bin and decided to put it in all of ours leaving the lids open.

As of this we all now have no bins for the next 2 weeks.

I emailed the council this morning and this was the response I received

"Good Morning Mr Passey,

Thank you for your enquiry. Unfortunately the council would not be able to assist you in this matter as it is a situation between yourself and your neighbour. Maybe putting your bin out very early morning could be a way of preventing this problem as long as the bin is out by 7am.

These people do not work so they can put there bin out whenever.

Any ideas what I can do or if any law has been broken?

I always assumed that the bin lid slightly up was an urban myth. My council doesn't have an issue with it.

Any idea which neighbour it was? Hide in the bin next time.

Have you talked to them? They might be willing to help rectify by splitting your bin into theirs if they didn't know. Otherwise I'd just toss their stuff back to them and kindly ask any other neighbors if you can place a bag or two in their bins.

Ask them for a refund for the bin collections this week as they have not fulfilled their contractual obligations for that week.

They won't take your bin as there's a bit too much in there? Tell them you won't pay your Council tax as you think that's a bit too much too.

The lid was at a 45 degree angle and they filed 4 of the streets bins like it so none were taken.

Do have a garden full of dog poo at the moment.

Gonna speak to the other neighbours that they filled then go round wen I get home from work with the ultimatum u take all our 4 bins full of rubbish to the tip. I if not I'm emptying the entire bin outside their house

Never poo on your own doorstep (or others, you get the jist). It will cause issues.

Best to go and tell neighbours the situation, make sure you know who it is and then approach them calmly (but firm) and tell them of the inconvenience.
They may apologise and offer to take your rubbish, or they may not. But you need to make sure you don't make matters worse with a hot head.

You do know they'll report your for fly tipping and you'll get done.

And how would that work if the refuse are not from your own? Just take the bags that is clearly not yours and empty at theirs. If reported, the contents won't be yours.

No?

Sounds like a retard council if you ask me, lid open or close, as long as rubbish is in the bin it should be taken.

As for neighbours, have a word with them and if it happens again let them know you will empty your bin over their front door

You do know they'll report your for fly tipping and you'll get done.

its not fly tipping because its a private road no council involvement hence we have to take the rubbish to the main road.

Pluss its all their rubbish anyway not mine.

WIll go round and have a word laster. Will record on the phone and let you know what they say.
