Jobseekers decision

I am absolutely fuming. :mad:

My brother got a job selling gearboxes through the jobcentre. After a couple of weeks there, they revealed he would not be paid on cards, so not tax was being paid. They took him off sales to stop him getting any commission and the supervisor (a roid pumped meathead) also decided to start bullying him. Needless to say he left. He returned to the jobcentre and told them of the problems. that he was being paid illegally and frightened for his safety. He has now been told that as he left his job voluntarily, he will have to wait until June to start claiming JSA again.

To top it off, the jobcentre want him to do 13 weeks voluntary work cleaning up canal banks 5 days a week, 8 hours a day. When he asked if this meant he would get his JSA straight away, they said no, he would still have to wait until June and if he refused the work, it would jeopardise his JSA claim in June.

To me, this seems a massive injustice. I am finding it hard to keep my temper under control tbh.

Didnt he report the dodgy pay and bullying/violence to the boss and/or jobcentre? Surely that was a first step instead of simply quitting?

It means they was not paying his tax and NI, so in effect, he was working illegally.

The chain of events happened so fast, there wasn't really much time to inform the jobcentre. It wouldn't have done any good. This wasn't your average professional place. It was a garage basically and any comebacks would have been straight on him for grassing.

Its a horrible situation but he really should have spoken to the jobcentre before quitting..If only to protect himself. Is there any way he can prove what was going on? If he can they he might be able to appeal the decision or something?
 
It's true they won't pay as he left on his own will, however there is nothing stipulating that he has to do any work unless he is claiming JSA, stating that it will effect his future claim is hilarious.
 
If he grassed them up they'd probably just turn round and say he was employed on a self employed basis and it was up to him to do his tax and NI.
 
He shouldn't have just walked out without approaching the job centre first, he doesn't really have a leg to stand on if he didn't report the problems.

With regards to the unpaid work, they can't force him to do voluntary work and it shouldn't affect any future claim, what will affect his claim is that he has left a role voluntarily.
