eBay dispute advice...

Didnt you say that your wife went to collect the damaged one? but now you are worried because you cant get the new one for her birthday? :confused:


Looking at the pics, your wife must have not even looked at the item when she collected. and surely she must have looked because of the noted damage to the base? So she checked the item but didnt see the massive scratches?

I dunno....i dont know which side ebay will take. best of luck to you though. I automatically side with you because of the seller using their professions as proof of honesty lol.

He's already said the thing is in pieces. Sadly, some people like to trust other human brings, sadly though a lot of the human race are scum and sell advertised products.

I would be very hesitant to trust anyone on ebay to be honest. Back in the olden days when it was little old ladies selling off their stuff, sure..but now its become a business for so many :/
 
I'm gonna roll with you getting your money back due to the inaccuracy of the listing - i.e. the damage is more than cosmetic, and it wasn't a "sold as seen". If the case works in your favor the seller will have to reimburse the return delivery costs.

In a private sale there is no need for sold as seen to be explicitly written as it is an implied term. However, it does need to be accurately described.

Also, getting return delivery costs reimbursed can be a pain as Ebay cannot force the seller to give them. Therefore if they refuse to pay them back it will require small claims court.

She cant leave neg feed back for you, and you buy on ebay for the item not feedback.

And the scratches look like from a wedding ring.
 
The seller has 100% feedback, so I would've thought even the threat of you leaving bad feedback (let alone dispute process) would have them itching to accept a return. Also, the fact that it's local pick-up is convenient for both of you, because the postage dispute would've been what made this messy, but taking it back and giving you a refund, I genuinely don't understand why they're fighting it, you'll win a dispute AND they'll lose their 100% feedback score if you don't give them good feedback, makes no sense from their point of view.

I don't agree that you're really out of pocket because you had to buy another one at short notice. If/when you get your money back from Ebay you'd have to buy another one anyway. Surely your wife collecting the gift takes the magic and mystery out of it a fair bit. Also, you bought her a dancing pole for HER birthday?! Seems more like your birthday present to me. :)

To be fair £200 is a lot of money. While I do think you could have avoided this arising by checking it thoroughly, I hope you manage to sort something out. Good luck.
 
Doesn't matter if it was inspected before. If the damage was not listed in the product description you can file for a not as described dispute, as explained.
