Car rear ended me. He claims i reversed into him

So i was at some traffic lights on a slight decline part of the road. Lights turn green and the car in front pulls off but stalls. I pull off and move about 5 foot then put the brakes on to avoid hitting the back of him. The car behind me then slams into the back of me doing lots of damage to his car due to my heavy duty chrome bumpers. It's not done any damage to mine. He immediately gets aggressive stressing out saying i reversed into him blah blah blah. My car was pointing downhill and not moving so that's impossible.

Had a letter from his insurance and i contact my insurance and deny responsibility. Where can it go from here? Can it go to court or will i lose out in any way?

This is the second accident our cars have been involved in accidents recently, and both times our cars were stationary. Not a good couple of months for motoring for me.
 
No, there were no witnesses, but he was blabbing on about how those cars that were there but have now driven off into the sunset would be witnesses blah blah blah.
 
Do him for insurance fraud, call the police and tell them.

A guy on a bike forum i'm on did this in his car and the guy has just been sent down for it.
 
I bought a cheap dash cam for this very reason, as I got sick of being at the mercy of idiots on the road.

From accounts I've heard from other people in your situation, I'd expect it to go in your favour. You were on a decline, and he went into the back of you. Without any evidence to support his claim, he's in a far worse position than you. Also, can't the driver in front give an indication as to how quickly this happened? There would more than likely have been a pause whilst you changed gear had you reversed, maybe he can confirm that this wasn't present?
 
Surely it will go 100% in your favour no matter what bs he comes up with. Aren't rear end shunts fairly cut and dried?



If there are no witnesses, yes - the companies will assume the rear car was at fault. However, if he can get someone to lie for him the OP is in trouble.
 
Well that isnt totally fair otherwise what happens when someone does genuinely reverse into you? :p

A mate of mine reversed at some lights to put into the other lane. He had pulled up too close to the car in front and only then realised he wanted to go the other direction. Quick check of the side mirrors (I tried to double check for him) and we saw nothing. Since the rear view was blocked with a full boot we missed the tiny wee Igo behind us.

The guy behind us started raging that we were going to pull some scam on him but we managed to calm him down and it all worked out fine. Mate admitted fault and that was that.
 
Time to invest in a in-car dash camera

I fitted a rear one to my car today funnily enough. Just uploaded a sample, watch in 1080p goodness. :) It'll be great for catching tailgaters or insurance fraudsters. £60 and 10 minutes to neatly wire it all in.


Also have one on the front.
 
I wouldn't worry in the slightest. If you go into the back of a car it is well known that you are considered at fault probably 99% of the time. The other 1% is the police who have been known to claim various other scenario's.

The other driver wont be the first or the last to claim this. I would bet my testicles his insurance pays out.
