Return / Refund on Faulty TV Advice - What are my DSR Rights?

Hi there,

Hoping somebody with a little better knowledge on this subject could help / clarify my rights here:

I bought a TV recently and after using it I noticed it had a very loud buzz (louder than acceptable over normal volume), having read on the internet it was a known problem on this model TV.

I raised the RMA request with the retailer and confirmed collection of the TV 3 or 4 days of the TV being delivered and the TV was picked up 7 days after it was originally delivered.

Come around 2 weeks later, the TV is still with the retailer and it has still not been inspected to be sent off to the manufacturer. I've done further reading and the problem I had is fairly common, so there's every chance I could get the same issue again.

Therefore, as the faulty TV is still within the hands of the retailer (returned in full original packaging), do I have any right to cancel this and get a full refund?

not under DSR since it's after 10 working days.

You should still be able to return for refund under SOGA, though, I believe.

tell them 'the goods were in breach of contract under SoGA. I am rejecting them and expect a full refund as is my statutory right. Regards...'

Hi there,

I've just had a confirmation of my refund.

Another quick question. I paid a credit card fee of 1.5% on the original transaction - am I correct that I am entitled to a full refund of this on top?
 
Yes, I've returned things before but I'm finding conflicting information on the net regarding what I'm within my rights to ask for back, as shipping DVDs is a bit cheaper than several thousands of pounds of TV.
 
yes, they must return delivery charges if the item is faulty.

looking around, though, you might not be able to get the extra card charge back. but delivery, yes they are liable for that.
 
They are liable for the initial cost of delivery as well under DSR, unless you pay for an express option I believe?
