Im selling my car and I forgot to mention to the person viewing my car that he needs to get insurance to test drive it.

So I have sent him a text saying this (can't call but I can go on my phone do this and post on here :D)

With regards to my (car). You will need to have insurance to drive the car and bring proof as the car doesn't have any. If you can't get any then you won't be able to drive it without buying the car first.

Is this a little harsh?

I don't think it is as if he got caught by the police test driving my car. He would get the point and fine but I am the registered owned and it would cost me money to insure it and get it back from the police.

Sounds fine to me.

Don't forget that if he tries to drive it under his current insurers' DOC clause, it's not eligible as the car does not have insurance under the current owner.

You (or he in this case) can get insurance for 1 day cover, if I called my own insurer they'd give me 1 day insurance on a car.

You do realise that if you do not currently have insurance on the car, then it needs to be SORN? Otherwise you may well get a nice fine from the DVLA.

Sounds fine to me.

This is not necessarily true, it depends on the wording of his policy document.

It doesn't have to be SORN'd if its on private land e.g. if the car is in my garage. Also doesn't need to be insured. It has to be insured and taxed if on public land.

If you don’t use or keep your vehicle on a public road (eg, you keep it in a garage, on a drive or on private land), you don’t have to buy a tax disc. Instead you must make a SORN.

If it's not insured it needs to be SORNd regardless of whether it's on your drive, garage or parked at the bottom of a lake.

As above - if it's not SORNd it needs to be insured.

You <might> get away with it for a couple of weeks, as we all know how efficient the DVLA are with their paperwork and I think you get a warning letter first as well?

Part of the govt.'s genius idea to stop uninsured drivers (because they're really going to give a **** if their car is taxed or not...) and in the process shaft people trying to sell a car or who keep a second car off the road and only drive/insure it occasionally...

The reason it has Tax is because I were using the car but now I am not. Also it is Tax'd because I have recently bought a new car and I were meant to be getting it fixed and would be needing my old car. This would have saved the hassle of me taxing and untaxing etc.

Unfortunately not a valid excuse - if it's taxed it needs insurance.

Edit: apologies if this seems like I'm pouncing on you - I'm not, I think it's a ****ing stupid policy that doesn't affect the people it's aimed at and makes life more difficult for everyone else! Just trying to make sure you don't get stung for £1k :)

Well unless the police man comes in my garage he will never know ;). Hopefully it will be gone tonight and I won't need to worry about it.

If not then I will SORN tonight. As I didn't know and now I have been informed.

It's done via an online DB, the letters are automatically sent out.

I guess I will wait for than then. If the car goes then I will just put the letter in the bin. If not I will SORN the car. Either way I hopefully won't get in trouble.

The DVLA isn't like a private parking company where you can ignore letters.

Although in reality I doubt you'll get a letter for a couple of weeks.

Don't bin it, just write them a polite letter saying "Sorry, I didn't realise. The car has been locked-up off the public road."

When my grandma died her car sat in the garage for about a year... and the nice people at the DVLA sent us a letter when I tried to get it back on the road. It was all resolved with no fines etc, but I did need to explain to get them to cancel it.

Well the car is sold.

My only question now is...
...if the car develops a faulty, say the turbo blows or the electrics stop working (which these things won't) what rights does he have? Is it sold as seen like ebay?

I normally Part exchange so don't know what happens next.
