Landlord Attempting to extort money from Mother

So this began some time ago with damp forming on a wall in my mothers room and in my room.

The room she is in leads onto a kitchen which is on the opposite wall in the apartment next door. My inside wall is an outside wall that has pipes which go through the outer brick wall where water flows as it rains.

We have known through owning our own house in the past to control damp via controlling house temps and through ventilating adequately.

He has said a few times to my mother when I've not been around that she is to do what she already does to stop the damp from forming. We do this anyway so he then said he will be contracting someone ( obviously someone he knows) to do work on the damp and repair the walls.

This sort of thing should be on the Landlord not the the client unless the client is absolutely responsible for which we are definitely not.

So who wants to see the work they did? because I tell you all they did was buy some paint and paint over the wall the damp is still there behind it and I watched as he did it. maybe half hour of work over 3 days of him coming 10 mins each time. I have no gripes with the workman but right now my feelings make me want to react to this landlord in a very violent way :mad:

Look at this, the damp will just come back and I know I have used this exact same treatment before. This is extortion plain and simple, He has also decided that a switch for an extractor that sits on top of a door that neither me or my mother have ever known about or used is broken and is also trying to charge £145 for that ( replaced a fuse ) for all we know it could have been broken ever since we moved in.

I ask you guys because I honestly don't know what to do right now on the one side we have solicitors who just want to make money off us and we could loose in court based on the way a judge feels on the day.

Im at a tether right now.
 
Did she sign anything to say she agreed to pay for the work?

Does her contract say anything about paying for maintenance?

If no then no worries, else pay up.

Either way, she should be looking to move asap as her landlord sounds rubbish.

Citizens Advice Bureau ... immediately. Do not respond to any correspondence until you've gather all your evidence and spoken to the CAB. Take photos, emails, etc that you have as evidence. Have a copy of the tenancy agreement (generic tenancy agreements usually covers that the landlords deal with damp if it is not caused by tenants)
 
+1 To the boxing stance. I wouldn't pay it OP.. Stop payments for one month to recover your deposit and move. Sounds like an idiot landlord

There trying to say that its caused by bad ventilation, they got a surveyor in to say that its caused by that. BUT DAMP can be caused by any number of things there is no proof to say that we didnt ventilate and we bloody well did.

Ye there trying to charge us for this ******* *******
 
Surely if the room needs a specific type of ventilation to avoid getting damp then whoever owns it should be installing the appropriate extraction? Also, £510 labour charge for painting is hilarious.

Then you will need a trusted contractor to perform the same investigation. A second opinion which contradicts the landlords findings because invariably a lot of landlords will have their own "buddies" for this stuff which helps themselves. A big company like Rentokil to do the survey (yes you will need to pay this cost but if they find in your favour you can charge the landlord!). Plus a lot of damp problems occur in really old houses due to cracked foundations and/or neighbouring houses.

There is no evidence of damp now because the "WORKMAN" painted over it....how can i get that surveyed.

Do as others have said, check the contract and speak to Citizens Advice. I seriously doubt you are legally obliged to pay for the work.

As far as im aware no, but if he got a surveyor (one of his bandits) to rule that damage was caused by the existing tennent he can charge for afaik. I think I may need to get a survey done but they did the work (PAINT THE WALL...) so how can we now do this...
 
Cab points to solicitor - Solicitor points to court. Court could cost us 10x more. Its like everything is here to **** us.

Why do you think court will cost you? Go to small claims. The losing party pays the fees and it's only approx £140 anyway,

I seriously doubt that any professional can establish that the tenants caused the damp unless he literally witnessed you doing something which could cause that.

What did you do with all the good advice you got? So we know what you have and have not done.

I remember that we have ventilation in the walls which we open we regularly have the windows open to make sure there is no condensation and the like building up etc its mostly mum who does it and shes owned 4 properties in the past and shes not stupid shes just incredibly depressed and im inexperianced in this she cant really hold her own on this.

The damp is not even there, the surveyor came they painted over the wall charged us said the wall itself was dry. There is no damp anymore has not been for a long time this is what gets me, he is charging just for repairing the "damage" he bought magnolia paint and stain block and charged 510 pounds labor for that...
