Company refusing to replace/refund faulty goods

I always call, when I wanted to change a product on order with OCUK I just rang up straightaway and swapped it as I knew an email/web form submission probably wouldn't be read and responded to in time. Some people seem to have a problem phoning strangers though.
 
Awaits the said company to reply to the RMA that the card is working fine and it is the stupid OP's fault for being rash and not checking / installing correctly.
 
Well, no it isn't. There is no guarantee that an email has arrived, it could be caught by a spam filter or dropped by the ISP at any point in the chain.

You're talking like the postal system is reliable and 100% efficient. haha. I've had more bother with the postal system than e-mail I can tell you that ;). But do chime on, has highlighting XYZ issues with one instance blocks the negativities of using another.

Emails are not considered a legal document, therein it is not an instant form of written communication.

True you can spoof the email address and such. But the company should be retaining all business related communication for X amount of years anyway. Saying that, what's the difference between disabling an account and deleting some internal audits :D

Although to be honest, I am more than sure PCW has been using emails and .doc files they've recovered for a long time in court proceedings against corporate fraud... Have you got 5 recent example cases where e-mail has been flat out denied as evidence based purely on the fact that it is e-mail?

The company phone suggestion made me laugh. No wonder outsourcing companies have blocked local phone numbers!
 
Use there when referring to a place, whether concrete ("over there by the building") or more abstract ("it must be difficult to live there").

The science textbooks are over there on the floor.

Also use there with the verb BE (is, am, are, was, were) to indicate the existence of something, or to mention something for the first time.

There is an antique store on Camden Avenue.
There are many documents that are used in investigations.
There is a picnic area over here, and a monster and a campground across the river.
"I see there are new flowers coming up in your garden." "Yes, they are the ones my grandmother gave me last year."

Use their to indicate possession. It is a possessive adjective and indicates that a particular noun belongs to them.

My friends have lost their tickets.
Their things were strewn about the office haphazardly.

Remember that they're is a contraction of the words they and are. It can never be used as a modifier, only as a subject (who or what does the action) and verb (the action itself).

Hurry up! They're closing the mall at six tonight!

Test your usage. When you use any of these three words, get in the habit of asking yourself these questions, but remember that they will not work in all cases though:

If you wrote there, will the sentence still make sense if you replace it with here? If so, you're using it correctly.
If you chose their, will the sentence still make sense if you replace it with our? If so, you've chosen the correct word.
If you used they're, will the sentence still make sense if you replace it with they are? If so, you're on the right track!

Recognize incorrect examples and learn from the mistakes. By looking over others' work with a critical eye, especially by offering proofreading or copyediting help, you can become more sensitized to correct usage and practice it yourself.

Wrong: Their is no one here.
Wrong: Shelley wants to know if there busy.
Wrong: The dogs are happily chewing on they're bones.
RIGHT: I can't believe they're leaving their children there, alone!
 
Or you could just use your works phone like everyone else does.

Or if they are a big enough company, you can try using a database like SayNoTo0870 and find an alternative number, some of which may even be freephone.


I don't get the obsession with calling? It's inconvenient as it has to be done now (unless you schedule a call), and there's no proof of who said what.

I disagree.

A phone is the fastest way to get your problem sorted. If you are sat around waiting for days and not getting a response by e-mail, getting on the phone to them will find out why as that person there is looking into it while you talk. Should they have made a mistake or anything, its also easier to get to the bottom of this when talking, as unlike e-mail they don't have time to formulate an answer or leave out the details. Things can also get misunderstood in e-mails and may end up in a lot of back and forth.

E-mail is fine the majority of the time.
All I'm trying to say is that in the case of the OP, after getting no response, making a phone call was not only the correct thing to do, but also the most rational. Trying to pull your payment and contacting the managing director wasn't really the best way of getting a response, sure it got one, but you could have just spoken to them and likely had the same outcome.
 
Oh I agree, if a company was stalling on me I'd get on and phone them... but I'd have tried email first. But there's no legitimate reason why they can't conduct business over email instead, unless they're trying to make money from premium rate numbers or are going to mess you around and don't want proof of who said what.

OOI OP, are your drivers up to date, had you fully uninstalled the old card.

Yeah i downloaded the drivers straight from Nvidia and uninstalled the old drivers using the custom installation of the new software.

As for the nay sayers saying i should have called, yeah i should have but its kind of hard to ring them outside there time of operation and like westfield said, information does not get passed on like it does on Email.

One adviser might agree with me on one part but on the next phone call if it does not get sorted the first time might disagree with me leaving me back and square one.

Its sorted now and will be collected Friday free of charge, prior to collection ill be taking pictures of it all so they cant fob me off saying it turned up smashed (Some guy sent his laptop back and they damaged it there and refused to replace and claimed it came in that way even though the guy had pictures of it before he sent it )

I will always email first but if i get no response within a reasonable amount of time ( 1-2 working days) i will call.

saynoto0870 is amazing as well if you have to end up calling a company.

Who's to say you didn't take pictures of the card then smash it and post it though? Pictures of the card isn't proof its in perfect condition when sent....?
