A certain Supermarket chain HAS NOT paid me AGAIN!!

I am bloody fuming right now, if you dont remember my last thread, I got nothing for all the overtime that I did, and I spoke to my MAIN manager, and he said Its all been sorted, and you will get your money next wages.

Just Had a check online, and NOTHING, no indication that I have been credited the money, just holiday pay, which I took 3 days off.

Thankfully they have got this month wages right (I think so)

Now, I just texted my manager saying, saying if this does not get sorted, I will take legal action (employment tribunal), and also have a talk once I return to my shifts.

On my Induction day, I filled in a union form, but never seem to notice the £5 they take out of my wages, So once I am officially in the union, I will get the union involved first. (If the Money does not go in my by next wages then I will take legal action)

Can Any of you link me/show me where I stand legally, links to forms e.t.c, that I can fill and MAKE Sure I get my money. (it Is a lot for me, around £500) Or is the union enough to make sure I get it done.
 
I don't think an employment tribunal will do much for you, unless the shop is refusing to pay you for discriminatory grounds. If it's just another incompetent HR department, which is likely, legal action seems rather premature.

What legal action do you imagine to be available to you? Contact HR, tell them you haven't been paid, cross your fingers that they'll get it right next time. Which they might.

edit: Eventually I suppose you could resign and claim constructive dismissal, but that doesn't sound like a good plan.

I did talk with them, and they said its all sorted, Went through head office and everything, Fast fowards to my next wages, I STILL BLOODY WELL DIDNT GET IT.

I haven't met a competent HR department yet. One job got my wage wrong every other month for the eighteen months I spent there. Exactly every other month. Bonus marks go to the lass who accidentally tore up a friend's A level certificates though, that was really crap :)

Try again, and again, and again, until you lose patience and find a job elsewhere, at which point it'll be really difficult to get your lost wages back. Or try the unions route and see if that makes HR any friendlier.

sounds like you never took legal action or threatened to so they didnt care if they underpaid you
 
Well, I didn't really care either. £300 one month and £500 the next was much the same as an accurate £400 every month. It wasn't very serious work. If they got it consistently wrong for several months I'd have got steadily more irritated and then moved to a similar job at a different company.
 
I was supposed to get 'signed off' as a 'manager' about a month ago (extra £1.50/hr) as I had completed my training, but had already been doing 'manager' duties for at least a month previous, as well as my contract changed from 25hrs to 39hrs (been doing 40+ for over 2 months).

That didnt get done before I went on holiday 2 weeks ago for a variety of reasons...none of which were my fault. So I lost out on 28 hours by going on holiday..not to mention the extra pay for not being 'signed off' yet. Finally got signed off today, and if I don't get the extra pay backdated for at least the last month then Im gonna make a formal complaint. Unfortunately there's not much I can do about the lost hours as increasing my contract hours was not a given.

It's retail, just like your job, and I really am not surprised. In retail especially they really couldnt care less about their staff, it's all about customers and profits etc etc. After this fiasco, its shown me they dont care about me, so from now on I am only gonna do the minimum that is required of me, after that I really don't care, why should I? Can't wait to get a new job, only been doing this 4 months lol!

Generally in larger companies it's the payroll department that deals with your payroll. Not HR. Which is probably why the HR people you've dealt with are incompetent at it. As it's not their job...
 
Your entitled to your owed money within 48 hours,tell them they have until Saturday to sort out your money and get it from the cash office,I have had this done a few times and always get what's owed to me within 3 days,they can do it but is a pain to get the forms signed abd they will try to fob you off and you will get it in next month's wages.

Not the sort of thing to do by text though. Way to put your managers back up, are you usually like this with them? Could explain the lack of care over getting it sorted for you. '

I actually wanted a career with said supermarket chain, as a plan b sort of thing if plumbing does not work out for me, So i always stay behind, get the job done, take all the stock back, however I still get a *******ing, because I am abit slow I have the smallest section (its not that small but compared to the others it is) and I always finish by the time the others have finished, however for a good 2 months, I finish my delivery 20-30 minutes before the shifts ends, and I am still too slow :\ (according to the manager, but people say I am not slow, just managers are never satisfied)

When I do get shouted at, I just take it, I do not want to cause a scene with the customers, however I have waited after the shift and explained my side of the story to the manager, I am firm, but I dont shout, I talk to them like how any person would like to be spoken to.

My probation or my 3 month contract ends this friday, and I still have not got my uniform, this is not looking good for me to be honest, I have not missed one shift, showed up to all the overtime, get the job done 95 percent of the time, however always staying back to finish off other peoples delivery.

Managers only respond to aggressive employees, and I just dont have the heart to talk to a person like a idiot, UNLESS I feel like im being harassed or something
 
Perhaps its the way you write posts and face to face things are a little different but if you worked for me I'd have singled you out as a trouble maker / just not the kind of person I want working for me with the attitude and asked you are not kept on.

That might seem harsh ( and I don't work in this environment anyway) but you need to consider that your manager doesn't pay you, you are one of thousands of employees being paid in one run so inevitably there is a single point of failure somewhere who is....failing. Having your line managet on side would really, really help you get this sorted sooner rather than later.

All threatening legal action will do....especially via text is make them think you are going to be far more hassle than is worth from a low level employee. Whilst you may not see it the skill set you bring will likely be easily replaceable, if you want to progress in there you've just seriously shot yourself in the foot.

I DONT GIVE ATTITUDE, you have no idea, how the managers get treated in that place, It goes like this everyone sucks up to the night store manager, then the section manager, (next one down) gets abit of slack from employees but not that much, and then comes my manager, who gets all the rubbish from all employees, and trust me they deserve everything they get. (my manager of course, however there are some nice managers, who everyone gets along with, with exception of a few incidents where they just abuse there power)

I am always talking nicely, the night manager, and section manager know this and always nice to me, its not there fault that I didn't get paid in fact he has been on holiday for some time and when he gets back I imagine he will make sure I will get paid.

Its just that I dont take rubbish from anyone, however I do it in the office, never abusive, just firm voice, and stand my ground that is all. Never talk about them behind there backs, I do comment sometimes on how my manager works, however never said anything bad about him to other employees behind his back

Don't get me wrong, you should be paid what is owed but in the environment you are in you need to play the game whilst in the period you can realistically be let go for nothing

Let me rephrase it, I dont talk bad about him behind his back, just his work ethics xD

Also I am trying my best to hold my job, infact I do not know who is responsible for me not getting paid, we dont actually have a HR department just a guy that does wages lol.

Agreed, last few companies I've worked for had a payroll department, HR don't have any involvement in pay or anything like that.
