Parking Ticket - Bin It?

Hi guys,

I park at a particular car park every day for work and today I stupidly forgot to pay my parking (do it by text message through RingGo).

Obviously been given a ticket by CP Plus (PCN) Penalty Charge Notice.

Do I bin it? Do I pay it? Is it worth appealing?

I also think there is another forum you guys recommend in this situation, but I can't remember what it is.

This is no longer quite as simple as it used to be - certain companies have begun taking people to court who ignore their correspondence.

Best thing to do it post up everything in the private parking section of fightback forums: they're experts on matters like this and 99% of the time they'll be able to give you a solid defence. Just remember that nowadays, that defence isn't always "bin it"
 
May be worth contacting them explaining the situation (how you use it everyday and normally pay - they should have it on record) and offering to pay the normal price.

Though I know this idea will be flamed in a minute :p
 
You forgot to pay to park so pay the fine.

Some of these companies now will chase the registered keeper so just pay it an take it on the chin.

I'd agree but some of those parking companies are having a complete laugh with the fine - some of them have gone up over £100 recently.
 
Beware advice given on Pepipoo. I ended up with additional points and a higher fine following their 'tried and tested advice'.

Does it say the company is acting on behalf of the council? If so you need to pay up, if it's a private company, ignore. I've been doing that all year, still not heard of anyone going to court.

Research the company to see if they can actually issue penalty charge notices.

Some companies claim that they've issued a penalty charge notice, but what they're actually doing is giving you a parking charge notice.

Make sure you're sure on this. You can't or won't get points from a parking charge notice, as they are nothing more than invoices.

If they take it to court, they can't claim for damages in excess of what they believe they will have lost, which is no more than £20 in the vast majority of situations.

Penalty charges are issues by the council and police and by those authorised to do so on the former's behalf. Anything else is as above an invoice from a private company trying it on.
 
Notice it doesn't actually say "Penalty Charge Notice" in full? It just aludes to it by using "Penalty notice" and "charge notice" multiple times, along with "PCN", if it was a Penalty Charge Notice, they'd call it as such in full without all the distractions they've shoved in.

They do this to make you think that you've been issued a penalty charge notice as they can't legally call their invoice as such.

So no it's not actually a penalty charge notice, but rather just an invoice. Ignore it. If they take it to court, and it'll cost them more than they're asking for to initiate court proceedings anyway.
 
Was it a railway car park?

Railway byelaws make the legalities different as far as I know, so be careful, I don't think it's as cut and dry as 'bin it' for something issued under railway byelaws.
 
Farnborough is in Guildford. Guildford is served by South West Trains, which I think is what the SWT is referring to at the end of Union Street. This looks to me to be a ticket ussued in a train station car park? If so then byelaws apply and I would be inclined to pay it in the same way I would pay a council issued ticket.
