To be prosecuted and convicted you must have intent, otherwise it is deemed an accident (unless gross negligence can be proved, which I don't think can in this case)

Just having signs up around mechanical machinery that can seriously injure or kill people isn't viewed as being acceptable by the HSE. Customers shouldn't have access to it, or there should be some form of guard or change in design to remove the risk.

Well, that makes it ok to have dangerous machinery that the public have access to then.That would be relevant if a kid had done something, this was all the mothers actions and she was the responsible person for the baby.

Could a toddler? No matter how you try to argue this, signs were not an adequate means of prevention of accident here. A simple design change to remove the gap in the belts would have prevented this occurring.Dangerous to a helpless 5 month old baby does not equal dangerous to an able bodied person.
The baby could not have put itself in that position.
