Hi

I bought a phone charger off of eBay and stupidly did not read any feedback, just looked at the score, but upon receiving the item I noticed it was a fake when it was described as genuine and secondly it doesn't even work. So I have asked for a full refund which the seller says he will give, but keeps avoiding when I ask him if he'll pay for the returns fee which is nearly as much as the item and the item itself had free delivery. His also giving two different addresses and going by some negative feedback his got he has claimed in the past items have not arrived so did not pay out.

Whats the best course of action to take? Already opened a case but he is very difficult and has pathetic English and I know exactly the kind of person he will be, type of people I'm sick of to be honest, people who make money out of scamming people. But it looks ebay dont care about SOGA and such or fraudulent sellers.

Is reporting him to Trading Standards a good measure too? he has numerous feedback saying about items that are fake and that have blown up aswell.

If the postage is nearly as much as the item, you didnt pay a great deal for it. You pay for what you get im afraid. Suck up the loss and don't buy off Scambay

I hate to say it but I would just leave him neg feedback and leave it alone. Learning experience, is it really worth the hassle for the small amount of money paid?

eBay will 100% take your side, start a case and you'll get both the cost and the shipping back. I've had it all refunded before when I've got faulty stuff.

Yes but isnt this only as long as you send back the faulty item? If this scammer decides he has not recieved it or claimes it is damaged I post etc then a refund wont happen? Might be wrong though.

Probably not worth it for the amount, but am just annoyed of being shafted with things like this, and looking at this guys account he has made thousands of the back of dodgy items being sold and is operating out of a residential house so probably isn't even VAT registered, people like him annoy me, they dont have to work hard and just make money by scamming people of their hard earned money and get away with it. I got a scum car clocker on the case of TS and I would love it if this idiot gets stopped aswell. He has sold numerous items that are fake and refused to refund, sold items that blew up! and he sends parcel that aren't paid properly for postage and the costs then picked up by the buyer. Makes me cringe just writing it.

I paid with Paypal, but he has offered a full refund, but wants me to send it back, which will cost money that I have to pay and he doesnt say if he will cover the cost and on top of that he has 3 different addresses (and going by neg comments he claims he never receives item back), I won't be able to get a refund until I sent it back, so I'm at a deadlock here.

Annoys me also the amount of sellers out there that sell fake goods and ebay don't do anything about it, as they roll in the cash for them.

eBay Resolution Centre --> Open Case

you'll get a refund, leave him negative and leave it.

did you pay with PayPal?

I have been had twice by ebay sellers who just don't sign for returned items, in that case Paypal will not refund you :(

Got refunded by seller without having to send the fake junk back! Not sure whether to just leave it at that, might just well do, shall I leave negative feedback? or is that being too spiteful in light of the person giving a refund in the end, maybe a neutral one instead?

selling fakes as genuine = always negative.

just called paypal, as that is quite interesting. they said if you have the tracking number and he doesn't sign for it or if anything happens on the way, you should still be eligible for refund. they might investigate with courier to find out what happened exactly. Once you send it it's pretty much out of your hands, but don't know your exact cases, so can't comment.

Nope. I ordered an iPhone case that was counterfeit, I started a case, they refunded item and shipping, didn't ask for it back, removed the item from eBay.
