Worth arguing PCN? - not fully in bay

If your mate could squeeze into the bay infront of you, could he not have parked in the bay that you 'attempted' to park in and then you would have had a full bay to yourself infront of your mate? Or was your mate hanging outside of the bay as well?

He was fully in his bay.. he has a small fiesta. He could have had my bay to be honest but didn't think of that, nor think it was an issue at the time. In hindsight though you are quite right ;)

But I agree, it's easy to come up with a solution on the internet, but in reality I wouldn't have bothered doing it at the time either, it would have been a bit of a faff.

I don't see the van being an excuse really. If the van is over the lines then surely you wouldn't follow suit and park over another space. Wouldn't you just find another space if there isn't a single free space allowing you to park within the bay? It's quite obvious that the painted lines of a bay mean that that area has been allocated as a parking space so you use that as a guide when parking. You can't just make up your own space just because someone else hasn't followed the rules.
 
Council issued tickets are enforceable, but they also have a properly adhered to appeals policy, unlike the PPCs. I would expect that if you've asked them for clarification or further information then they should suspend the ticket for the time being until they've provided you with the aforementioned info.

Being a public body they are also bound by thousands of rules and regulations and these alone may help you avoid the ticket (I recall one such regulation from a TV programme about these things that where they are individually marked road-side parking bays the beginning and end of the parking section must be indicated by a double white line - if it's only a single line at each extreme then it doesn't comply with the rules and the ticket is unenforceable).

I'm not sure how accurate the above is, as I say it's only a recollection from a programme on TV a number of years ago.

The council will probably tell you that an illegally parked van is not a reason to illegally park yourself in the same way.

It does seem a bit weird to be enforcing parking bays outside of parking restriction hours.
 
Nottingham council are gits fior this including the outside line, it is near impossible for me to get within this line and impossible without risking damaging my wheels
 
As it is a bay to diagram 1032, does it have double end markings at both ends of the row of bays? Many don't have and those that don't are technically unenforceable.
 
Did the sign say "vehicles must be parked in marked bays" or did it says "vehicles must be parked within a single marked bay".

One makes parking outside of marked bays a PCN one makes straddling 2 bays a PCN.

Can be argued successfully as I have seen it done :)
 
It's worth a letter of appeal. Upon reciept it resets the payment deadline anyway and you never know they may just fold over. I've sent a whinging letter in the past when I was technically bang to rights and had the PCN withdrawn. I got a 'naughty boy - dont do it again' letter in return :p
 
It says

You MUST park within the markings of a bay

Like how they capitalise the must but its in super low size font on the ticket machine. To be fair given its free from 6pm - 8.30pm, why would i read the rest of the rules? :o
