eBay dumbasses

Can I make a fake eBay account and buy it, and wind him up? I know I am bound by the terms of the contract, but I'm not sure what rights he has for selling it in the first place?
 
Yes he had worded it so you are buying a pre order for the listed machine, not the actual machine.... crafty but only fools the dumb :D

The thing is though, if the seller words it cleverly, then the buyer doesn't have a leg to stand on.

Not strictly true. Remember that EBay side with buyers in a great majority of cases. There is certainly precedence for EBay siding with buyers where a seller is attempting to be clever by "wording".
As the issue would then become legal, EBay like to stop it before it gets that far - hence the fact his adverts keep on getting deleted.

They have zero chance to get the PS4 from him only has a 4 rating he is pure scum bag.

Or some less well written version of that. This was years ago, I said no, made sure he'd left good feedback then left him some nice red feedback.

I no longer use ebay for sales, only ever buy things on there.
 
I still use eBay but this is just another reason for why you have to be very careful.

I would hope ion this case though that eBay would side with the buyer even though they need a Darwin award for buying it in the first place.
 
I see that the listing has now ended... but he did have another positive feedback this morning!

I only hope that the two buyers are indeed happy with their purchasers, and receive what they expect! ;)

Edit: On reading the original listing again, he did actually say "I will try to deliver the console on the release date however no guarantees can be made." which is interesting!
