What bugs me is when people say these things are a scam. Obviously people making these lists are hoping that people don't read the description and believe they're buying the console... hence the high price tags.

But the majority of these listings state "this is a box, not the console" or "this is just a picture".

They received exactly what they bought and how it was described.

This is the box, it is rare to get hold as not many were sent to shops for customers to buy and it is a great for collection. Box is in mint condition real bargain if you ask me!!! Guaranteed For Christmas as well.

:p

I like the fact the seller put "Thankyou for your purchase" on the back of the photo one, genius!

love the comment from seller: "Box is in mint condition real bargain if you ask me!!! "

not sure the people who buy this should be refunded since he clearly says it's for a box, although some people will not pay attention to that. that said it should be listed under "accessories" and not "consoles", so buyer could argue and get refunded

Lol what a complete idiot. Even acknowledging it said it was a picture and he still did it...Darwinism needs to find these people.

ebay would still refund them, they don't want the bad press i imagine

Not that I am thinking of doing this, but what recourse does the buyer have in these circumstances?

Mr Clatworthy was informed by eBay yesterday that, as he paid via PayPal, he can expect to receive a full refund from the seller, who has until Monday to pay up.

A spokesman for eBay, the online marketplace, said: "We don't allow listings which mislead, and will take action against this seller.

"Customers can shop with confidence on eBay as we guarantee you will get your item or your money back. Mr Clatworthy is covered by the eBay money-back guarantee and we will be contacting him to put things right."

In most cases, assuming you've paid by Paypal you'll get your money back as although the description may be right by listing under Console Hardware it's a misleading ad and quite blatantly an attempt to rip folk off.

paypal will side with the buyer, they see it as scamming basically.

although the advert clearly states it is a box or a picture, etc, they use common sense in these type of listings.

who would pay £500 for a cardboard box or a sheet of a4 paper with a crappy picture on it?

think about it

does ebay or paypal protect you in this case?

It should do, especially if it's in the wrong category (Console instead of accessory for example) or if the listing picture is just a photo of the box rather than a picture of the photo of the box (if they're selling a photo).

I can confirm you will get a refund really fast when it comes to this kind of thing, 2 years ago I bought a wireless Sony headset for PS3 off some chap on eBay. The picture was of the headset in the retail box as you'd see on any retail website and the description was all about what the headset could do and it's features etc etc. It was mentioned that the 'item' was 50% off due to store closing down soon, so I thought hey this looks like a great deal so I pulled the trigger on it.

A few days later, I get posted a CD along with my receipt and I thought wtf is this. Put it on the computer to find a text file on the CD listing a number of different websites where I could purchase this headset at a 'bargain price', I hopped back onto eBay immediately only to find the user was no longer on eBay. I was able to still view the auction though and sure enough in very small text at the bottom of the description it said 'Note: You still not receive the actual headset, you will receive a CD with the best websites on where to buy it' or words to that effect.

I was able to contact the guy as the paypal transaction showed his email address, he never responded so I raised a case with eBay/Paypal and he then replied saying I got what I paid for. At that point paypal issued me a full refund, this all happened the same day I reported the issue so it all got resolved the same day. I'm not a scientist but I am smart, smart enough to know what I'm doing online at least and you could say technically it was my own fault because I didn't read the small print but everyone has lapses in concentration but what I put it down to is the seller being a horrible human being.

See now this, this story I can appreciate.

This is clearly a scam and the seller had gone to great lengths to disguise the fact you were actually buying a CD.

But some of the current listings on eBay clearly state it's a box, and make no attempt to hide the fact or pad it out with what the box lists or what it "used to have inside" etc.

Oh no, I'm not saying the links you provided are in the same category I looked at the PS4 Assasin's Creed box auction and knew straight away that was just a box I just gave my story for the people asking if eBay/Paypal would refund the money.
