People Selling PS4/Xbox One Boxes and Pictures on Ebay

The 19-year-old student, of Bilborough, had saved up in order to buy a limited edition Day One version of the console as a surprise Christmas present for his four-year-old son, McKenzie.

paypal will side with the buyer, they see it as scamming basically.

although the advert clearly states it is a box or a picture, etc, they use common sense in these type of listings.

who would pay £500 for a cardboard box or a sheet of a4 paper with a crappy picture on it?

Anyone that buys that deserves to get burned. It clearly states it's a box and does not hide the fact he is selling a box and not the console. The only thing people will complain about is it's in the console category which it shouldn't.

And that it's new and unopened - I assume it's been opened or the console would still be there!
 
Technically under the sale of goods act the seller has done nothing wrong. Unfortunately the buyer being an idiot is not really covered.

As the sale of goods act is law and above anything eBay say the seller could contest and say he sold exactly what he described....
 
There are a few of these on Gumtree aswell. Unfortunately i think the Gumtree user base is even more stupid although as you have to go to the persons house to pick it up obviously. And when you find out its just a box you know who's window to brick

Pure stupidity. Entirely buyers fault IMO considering the item description tells you what you are buying. Besides, I wouldn't dream of buying the latest consoles on eBay right now because of these untrustworthy sales going on.

Not as many but you still have rights.

PRIVATE SALES

When you buy goods from a private individual, you don't have the same rights as when buying from a trader. The legal principle of caveat emptor, or 'buyer beware', operates. You have no right to expect that goods are of satisfactory quality or fit for their purpose but there is a requirement that they should be as described. You should check goods thoroughly before you buy them.
 
I bid on a code on the xbox for Forza, I interpreted it as a code for Forza the game when in fact it was for the DLC, I bid £32 or £33 and it ended up selling for £34-36. I got lucky.

Yes they are, they know full well, thats why they are putting auctions up for pics and boxes in the first place. Its fraud plain and simple. Yes there are idiots who don't check the listing fully and thats what these people are trying to exploit.
 
Why isn't this illegal? Surely it's so blatantly unethical and it's purpose is to defraud somebody, the seller should be punished accordingly? :mad:

It's not illegal though is it? It is advertised as a box and sold as one.

There is a roaring trade in Breitling watch boxes, they don't contain the watch and yet sell as the box is an item itself.

Would say the scam would work better on gumtree, you don't have to collect in person. Just try and sell anything high value and you will have tons of scammers wanting you to send it off
