Am I Being Conned? (Buying Xbox One)

Why take the risk giving out your bank account details when one cheque has already bounced. Just get another cheque. Giving them your bank details is not some magical method, just means it's quicker than a cheque but frankly this seller can't be trusted. There's no way I'd give some stranger my bank details even if it is "safe".

I'd bet even if you gave your account details they still won't pay up and will give another lame excuse.

If you paid by credit card via PayPal, then you have Section 75 credit protection. Which means that you can claim all your money back. This applies for all purchases over £100, including online and foreign purchases.

This is why I always use my credit card for purchases over £100. I only even have to pay £1 on my credit card as long as the total order is £100+ for the protection.

Section 75:
Under Section 75 of the Consumer Credit Act, the credit card company is jointly and severally liable for any breach of contract or misrepresentation by the company.

This means it shares equal responsibility with the retailer or trader for the goods or service supplied, allowing you to also put your claim to the credit card company.

You don't have to reach a stalemate with the retailer or trader before you can contact your credit card provider - you can make a claim to both the retailer and credit card provider simultaneously.

This right is particularly useful if the retailer or trader has gone bust, or it doesn't respond to your letters or phone calls.

Section 75 of the Consumer Credit Act also applies to foreign transactions as well as goods bought online, by telephone or mail order for delivery to the UK from overseas.

Not quite as simple for paypal as it is classed as a third party. You are not protected under section 75 for private sales.

Payments through Paypal and similar services
There are some transactions where the company that deals with your credit card payment is not the same as the one that provides the goods or service - such as Paypal.
If you use your credit card to pay for something through PayPal and the funds go direct to the seller, then as long as the company you're buying from has a 'Commercial Entity Agreement' with Paypal you may still be able to claim under Section 75 for any misrepresentation or breach of contract.
PayPal offers its own buyer protection scheme, called PayPal Buyer Protection, so it's worth checking if you'd be covered by that if you have a problem with your purchase.

Blatant scam,takes money and release day is over the 45 days mark for a paypal claim,that's a lot of money to lose dude and do hope you get it back.

I think it was even discussed on this forum that people are scamming this way...
op has enough posts that he should know better.

I do hope he gets his money back though but I find it unlikely unless he can find others that have been scammed and you all contact the police because surely it is fraud ?
 
I dont even understand why the OP didnt even mention this on the forums before commiting to it, its so obvious its a scam as delivery of the item would have been over the 45 days Paypal allow to lodge a claim once payment is taken...

I have very little sympathy for the OP just knowing how many mechanisms he would have to consciously ignore to do what he did...

Echoing the above sounds very much like a scam.

The xbox one "welcome pack" if posted from the seller was probably to cover themselves so it proves that you received "the item" ;)

I'd conatct Paypal on the phone and hope for the best to be honest.

Sorry mate you been scammed. He delivered the welcome pack so he has tracking info incase you had disputed earlier. What a son a gun! Feedback counts for **** ** and ill learn from this in future.
 
If a Paypal account is funded via a Credit card and the account was to get scammed the same as the OP would they be able to claim from the CC company ,, u recon ??

Any chance of the ebayers name? Via trust or on here? Curious if we can try to be productive on this ;) was it a "power seller" or?

If this was me I'd be no loner concerned about the money and be just after an address for, erm, "payback" :D I'm wondering if maybe they have slipped up and bought things under their account, therefore maybe potentially leaving traces to get an address of this "person".
 
Just give eBay or PayPal a call and explain it was for a preorder and has been longer than 45 days. I'm sure they will sort it out without issue, considering they allowed the preorder on their site. Also point to any ebay messages you have referring to a refund.
