There seems to be a lot of confusion around the issue of what the law dictates and what personal morality states. Not that I am surprised, merely an observation.
 
Is it wrong of me to feel jealous for these kids and relating it back to the days when I was at school? I'd have given my left nut to do stuff with a teacher looking like that tbh

The only thing that bothers me about this story was the fact she is married and for that I'm glad she is suffering and has been smeared all over the news for the nasty **** she is.
 
Quite right as well in my opinion, it's a complete breach of trust, and thoroughly unprofessional.

They are in a position of trust and authority, and this is a complete disregards for it.

You are not legally classified as an adult until you're 18, so they were not "both consenting adults". One was an adult and one was a minor.

Legally and morally she was absolutely in the wrong. I am not saying if I was the lad in question that I'd have any complaints, but that doesn't excuse it. As others have said, the law must take into consideration things like grooming, and obviously in a position of power you with a MINOR then you should not be using that to get sexual intercourse. And I am sure we'd all feel differently if it was a 54 year old Drama teacher and some sweet 16 year old girl.

How about if it was a male teacher and a 16 year old female, you think it would still be fine?

Undeniably this is a betrayal of trust and a teacher should know better. On the other hand what a lucky SOB. When I was 16 if my business studies teacher so much as winked at me I think I would have jizzed right there on the spot :)

That's not the case. Seeing as sixteen year olds can marry in Scotland I think you'd have trouble stopping them shagging.
 
Age of consent is 16. That means, in case you are unaware of it, that if you are 16 or over then by all means you can legally indulge in sex with whoever you like (as long as they are 16 or over and have consented).

And you haven't explained the position of power thing at all. You've just said its wrong.

Apparently if you have a position of power OVER someone e.g. doctor, teacher, carer then it is illegal for them (until reach 18)

Its not really explained though...just a statement. How about if you're a postman, lawyer, manager of a company, ok for them to have sex with a 17 year old?



Ahh you say she was "grooming" him then? As you mention it? Or is it completely irrelevant to THIS case......

Just to clear this up, anybody with any legal background able to correct my understanding here?

Because the age of majority - or adulthood - in the UK (including Scotland) is recognised in law as being 18, as such the teacher (a major) acts as this lad's (a minor) supervisor in a legal sense. That is why it is penalised by the law in the Sexual Offences Act.

For Scotland, being able to marry at 16 is nothing to do with when you're considered an adult, it's in a completely different statute regarding the age of being able to enter into contractual agreements (legal capacity). As such the analogy of marriage is a false comparison. Is that right?

Seems to be my understanding of it, anyway.
