Just read this story... :eek:

"Miss Lindsay lodged a formal grievance five months later"

I've got 2 young kids that will have to grow up in a world this bonkers....
 
Daniel Matovu, for Miss Lindsay, earlier told the court: "White people don't get called golliwogs. The word is an overtly racial comment.

”Golliwog cannot be interpreted in any other way. What the authorities make clear is that, when something is inherently discriminatory and clearly has racial overtones, there is no further debate.”

White people aren't called Black too. Should we start thinking twice about using that word as a description of a person rather than beating around the bush?

Well to be fair, it is more dark brown and other varying shades.

What gets my goat is when a white person gets moaned at for including skin colour as part of a description "the black guy over there". I can't see that as anything different than saying "the ginger guy over there". Just a descriptive term.

No.

The real issue in the case, he said, was "why did Mr McAleese say what he did? Was it because he knew he had used the word on the grounds of her race, but dressed it up as innocent chat? Or was it for some other reason?"

The chef refused to admit saying "golliwog" despite apologising to the woman, and admitted that the term would be racist. He seems to have very little crediblility. And besides, the offended woman will not get any compensation since the application was clearly made too late. Can't really see anything broken there.
 
The judge is clearly an idiot words are never racist it is the intent of the individual that is racist and how anyone is such a powerful position can come to this decision is beyond me. The man is claiming that if I say within hearing of a black person that 'there used to be a golliwog on the robertsons jam label' that I am a racist what a load of tosh.

Rubbish like this does the wider race and equality debate no favours.

It's called a Golliwog. That is its name. What the heck else are we supposed to call it??!!

Where does it mention this?

In re-reading the article it seems to suggest the complaint was upheld but at the bottom it says "The Appeal Court judges dismissed Miss Lindsay's challenge to the dismissal of her case on grounds of delay. Her other claims of race discrimination had earlier been rejected by the tribunal, although she still has a victimisation claim against the LSE extant" intimating that her claim was dismissed but could still claim something??

I suppose it very much depends on the context in which the word was used but surely if it wasn't directed at someone and used in a conversation about the jam manufacturer, how is this offending someone?
 
Shame he didn't say he liked to spread Robertson's jam on a Jacob's cream cracker, then the white people could sue as well.
 
He isn't the first and won't be the last who thinks it's a humorous topic to discuss in front of black people.

Put them out of their misery? Or is it actually just your misery? I have to say, I'm certainly pretty happy about things in general.

Don't like it when it gets awkward around different races? Just move to the country so there aren't any different races.
 
Ffs, It's just a drawing of a character that happens to be black.

Fair point that at one time in society it used to be a racist slur but in modern society some people try to move on from that assumption.

The sincerity behind it was obviously in reference to the character and nothing more, especially as they were teaching (right?) and discussing just the labels.
If he'd called her one and lol'd infront of the class, then you could say it's fair to assume otherwise.

As always assumptions can make an ass out of u and me but where does it end? Someone has to drop it, should have been the judge.

As your OP is such a low effort post it's pretty hard to work out what you think may indicate our justice system is broken. Is it the 5 months (bolded), the fact that she's black, the Judges comments?
 
Presumably they had to say the word in court too... if its offensive in any context couldn't a black person working in the court also sue the judge?

There must be more to the case surely - saying a word in *any* context shouldn't be automatically offensive... Two colleagues discussing a product which used to use these characters is hardly an inappropriate use of the word. If he'd called her one or brought it up deliberately in order to offend her then that is different....
