Lawful killing of Mark Duggan

Scumbag or not he wasn't holding a gun when police shot him, how is this lawful?

Because the officer at the moment he pulled the trigger had an honestly held belief that Duggan was armed, and posed a risk to his life, the life of his colleagues, or the life of members of the public.

The jury have decided that the belief was mistaken, but that doesn't mean it wasn't honestly held.

The inquest report sums it up perfectly:

1) Did V53 honestly believe or may he honestly have believed, even if that
belief is mistaken, that at the time he fired the fatal shot, that he needed to use
force to defend himself or another; if your answer is NO then he cannot have
been acting in lawful self defence and you can put that issue to one side; if
your answer is YES then go on to consider:
2) Was the force used – the fatal shot – reasonable in all the circumstances?
Obviously if someone is under attack from someone he genuinely believes is
violent and armed – then that person cannot be expected to weigh up precisely
the amount of force needed to prevent that attack. But if he goes over top and
acts out of proportion to the threat then he would not be using reasonable force
and his action would be unlawful.
 
Sad to see what people are saying on twitter about this. Watch the armed police video on the Lee rigby incident. They have fractions of seconds to make decisions. Nice to see the duggen family catchphrase that sounds like its inciting riots too. Lovely
 
From the news report I've seen the guy had a gun at some point that day so nothing to suggest he didn't have it on him at the time. He got killed because he had a gun and was a risk to innocent bystanders.

Moral of the story? :rolleyes:

Shouldn't people concentrate on the fact he had been seen with a gun and where did he get that from? Lots of fine, upstanding citizens aren't caught with illegal firearms on them...
 
Made up to see one less scumbag on the streets, but the officer who shot him shouldn't be allowed to carry a firearm anymore as he shot somebody armed only with a mobile phone.
 
These things are tiresome.

The 'want justice brigade' actually mean 'we want our boy found not guilty of anything ever, no matter want.' They don't care that a jury listened to all the facts and made a decision, they just know the police are bad and their boy good. We then have the 'masses' taking a side based on 5% of the data and tabloid spin. To listen to some of the numb nuts talking on the radio this evening it matters not one bit about facts, just that 'its wrong'.

I don't know enough to comment, I'm happy the jury do and happy to support their decision.
 
I won't lose sleep over it tonight, one less gun on our streets. One less idiot on our streets who helped to out that gun on our streets.

Well done to the police for doing their very hard job to the best of ability.

I'd rather be judged by 12 than carried by 6.

PS.. And the courts

lol, or 12 for the one and then however many police are ever involved in making sure 12 people are not killed by gun crime. At least now if I am ever at risk a policeman will feel a little better about pulling the trigger to help me.

Sounds like the local scumbags are going to use it as an excuse for a riot. Hopefully won't become 2011 all over again.
 
Hopefully that nice shiny water cannon the Met have on loan from the PSNI will get an outing if it does kick off again.


Blegh they can have a shower at home! just let the police use equivelent force for the night. As soon as they get a few licks from a truncheon the majority will crawl home feeling sorry for themselves.

Just read through all the articles by various outlets and DM are really pushing for a riot yet the comments section seems to be full of people I actually agree with (somewhat depressing ha).
