Hi all,

Won an item on eBay, now I've yet too receive the item so put it in dispute. Anyways with regards to PayPal, am I right in thinking that PayPal would refund me no matter what and just put him on debt so he owes PayPal?! I used to think that because he would have already taken the cash out of PayPal that I'd be stuck... For a long time.

Paypal will take the money from his account if they rule in your favour regardless if he's taken the money out already.

I believe if he still has a card linked to paypal they'd probably charge it.

Yeah, they use the details in the DD mandates or linked cards even if the funds are moved out of his paypal balance.

There are many threads around where people say they can't withdraw directly from your bank account but many many replies from people that have had it done to them.

Thinking about it logically it's the only way a resolution centre could ever work.

Don't their T&Cs state that you must keep enough in the account to cover any transactions that may be flawed (or something to that effect).

no. in case there's not enough funds, you'll go into negative balance.

you can't use the account, until you settle that. if you don't, they will chase you after a while.

yea I was -£70 from a scammer
just edited all the details from my paypal and unlinked my debit card.
made a new paypal account with a fake name.
linked the same debit card lol....

never heard from paypal

...yet.

was it recent? In the past companies used to write off such minor losses more, but I've seen Three chasing 30 quid few weeks ago. But it wasn't too serious, just letters being sent to last known address.

£30 is big business compared to mine. Apparently I owed £12.50 to Three from the end of a contract last year, so they paid a debt collection company to write to me no less than five times in a week, as well as phone me. The fifth letter offered a £9 settlement, and I'm pretty sure after accounting for staff manhours, postage and calls they ended up out of pocket. :o

OK but I will get my money basically either way if he does or doesn't have the funds?

yes. if you're the buyer making the claim and paypal rules in your favour, you'd get the money. if seller's account doesn't have enough funds, PP will pay out of their own money and chase seller.

Perfect, that's all I wanted to know as there's the same item i'd like to buy ASAP :)

Thanks guys.
