Doing 47 in a 30 :(. No excuse and not after a way out as i know i was in the wrong. BUT, me and the Mrs are wondering who was driving as over the period of days we've been snapped we were both going to various wedding venues in and around the area so are not 100% sure who it was. I'm pretty sure it was me but we want proof first before signing the form and accepting the fine etc.

Do i just simply phone and request the photo to show who was driving or do i need to do this in writing?
 
Well if you know you were doing 47 I guess you can discount her by asking if she drove at an indicated 50 in a 30? If she says no then I'd begin to think it would be you..
 
Best to send them a letter via recorded delivery asking for "pictures to help identify the driver". Be aware this doesn't stop the 28 day countdown to name the driver.

It's always wise to ask for photos unless you're 100% sure, as things can get a bit messy if you name the wrong driver and they happen to check the video.

Just remember, they will have the photo of whoever was driving at the time and will look at this when administering the fine & points. Unless you dress up of a weekend and look like a 'Sophie' behind the wheel.... FORGET IT!

Theyll reply to say theyll only provide evidence once procedings have been issues, by which point youll be outside the 28 days and the summons winging its way to you will include the s172 offence and you face the fines and MS90 offence code

Most areas will send pictures so long as you phrase the request as asking for assistance in identifying the driver. Demanding evidence will get you no where.
Intentionally naming the wrong driver is perverting the course of justice, and can land you serious jail time.
If wish to claim you are unsure of the driver, then you have the high hurdle of proof to show due diligence that you tried to work out who was driving. Examine receipts, phone records, appointment diaries etc to try and work out who it was. This is hard but not impossible to prove, but mags are sceptical as they have heard every excuse before.
Do not reply to the NIP in an ambiguous way, as this will likely get you a charge of failing to identify and an MS90 on your license. Try and obtain pics, if its obvious who was driving then no problem, if its not, then the most likely of you should put your hand up and take the points, dont turn a simple 3 points most insurers ignore in to an insurance crippling offence of failing to identify.
 
My NIP arrived 8-9 weeks after the event. When they provided a picture in court, all it showed was the reflection of the clouds in the sky on my windscreen

That rarely happens anymore. There's nothing to be lost by asking, as long as he remembers to reply in time.
 
Fingers crossed you won't be looking at anything worse than 3 points and £60, that's what I got for doing 47 in a 30 2 years ago.
