Pay issues with Employer

Hello GD! Never thought I would make one of these threads but here I am.

My current employer has not been paying me properly for the past 5-6 months. It is always late, payments come in bits and sometimes overlap every month and I've not had a payslip for the past 6-9 months.

I've also made some payments for the employer on my personal credit card which amount to a fair bit of money.

I know that I can reclaim for my pay but can anyone shed any light on whether I can claim for the payments made on my credit card. :confused:

I've spoken to ACAS this morning and they've told me to start by sending a letter which I am.
 
Step one, send a letter, job done.

Step two, start looking for a new job. If they are having that much cash flow issues that you are buying things for them, the outlook is bleak. I've never heard anything so ridiculous! :eek:

Why oh why did you spend your personal money on your employer? This should have rung alarm bells for you. Your employer must be in massive financial difficulty.
 
Let me guess.... small business where the sole guy in charge is owner, manager, HR all in one.

Is it a ltd company or is he a sole trader?

If you have had no wage slips how do you know he is paying your NI contributions? i am assuming you are on PAYE not self employed.

If he is a sole trader i would start looking for another job, mean while take back all the items you have paid for and make a formal request for youre correct wages owed as well as wage slips and proof of NI contribution payments, otherwise insist you will have no other recourse but to get the inland revenue involved etc... he will prob back down.

ps look for another job anyway this sounds like an arse company tbh

I have worked on R&D where you sometimes put your hand in your pocket for an employer. However more serious is the irregularity of pay IMHO. You can rate your employer by how timely you are paid. I too would avoid paying for stuff for him on that basis.
 
When you say "made some payments for the employer" are we talking stuff for the business in general, or expenses specific to you/your role?

It's not that unusual to pay for some things from your own pocket and claim it back at the end of the month (e.g. travel, subsistence etc.) but if you're talking about stocking up the office, or buying equipment etc. then obviously it's a different matter!!
 
It is a limited company, he is director and I am the only employee but it is me who does all the work.

Is it bad for me to go after his clients? Many of whom he will not be able to support as he does not have knowledge and I think they'll be more than happy to work with me.

I've made credit card payments nearly amounting to 3k :(

If he can't support them they will go somewhere else anyway. Don't worry about him, look after yourself!
 
Its not so much about the money, its the NI contributions and tax.

You need to get this all in writing ASAP and take copies, use recorded delivery to yourself if need be and keep all receipts to do with it. Then be upfront 100% about with him. Give a two weeks to repsond. If nothing is forthcoming, get the TAX man/inland revenue involved and as other have said start looking for new work now.

Do not be taken for granted on any of this and stop buying anything on your credit card even expenses, get petty cash off him.

OP I feel bad for you but you are either very nice or very naive, maybe both.

You need to secure your future first and then start worrying about recouping monies, look for another job and in the mean time keep a diary of money paid to you and money you have paid out to him. Make an itemised list and dig out statements and receipts of everything you have spent on the business.

Write the letter you have been told to and attach copies of your receipts and statements. Because its only the two of you I suggest you schedule a face to face and have a chat, hand deliver him the letter only if you cant make an arrangement for repayment.
 
I'm curious how you survive when you "haven't had a pay slip for 6-9 months" and have paid HIM over £3,000...

Doesn't make much sense

Check it up with HMRC mate.
Start keepign a record of everything.
Don't agree anythign verbally, all via recorded delivery means only.

I'd keep names and numbers close in case you do decide to go solo.
