Ebay postage

I bought a brand new petrol cutter from a business on ebay. Couple of days later it isn't work properly and I want a refund.

Who pays the return postage? In the ebay listing, ebay says 'buyer to pay for return postage?'

The business says I need to send the item back to them so that they can inspect it to see whats happened and won't cover the return postage atm...

Whats the actual legal procedure here

For faulty items, they're supposed to cover postage.

I had a food mixer break at the start of the year, and the company I bought it from on ebay sent a courier to pick it up, I'd ask them to do that personally, especially if it's a big item.

if they're being funny, just open paypal dispute.

what people say in their listing about returns doesn't really matter much.

New or second hand?
Private seller or a business?

If a business then yes they should cover return post

If registered as a business seller, I believe you pay for the postage back at the start, after which if the item is indeed faulty they must reimburse you the return carriage and obviously the new item/refund.

You need to pay for the postage and then chase them to reimburse you for it. My experience of this is that it isnt worth the effort with some business sellers, just use a cheap courier such as Hermes and the cost to return will be fairly small anyway.

Theyre supposed to, its happened to me a few times that they havn't and thats incredibly fustrating!

With it being eBay the op could just open a dispute if the seller doesn't comply

I don't think it's going to be as easy as running to eBay/PayPal if the seller doesn't coff up return postage. Whilst under the Sales of Good Act you're entitled to a full refund inluding the return postage on a faulty item, the chances are the person you deal with at eBay won't know this.

Are eBay actually governed by the soga? New and second hand items? Serious question. I always though auctions weren't covered.

eBay is well aware of this, and will comply, as well as making a business seller comply also.
