Ha, fair enough. I really had no idea at the time I submitted that first one whether it was valid. One lad at work said he'd had success with it and the guys on the fightback forum said there was no harm in trying as you get to appeal again so I went with it. :p
 
your POPLA appeal that was upheld right? what did you write different?

It was pretty much the same as the second one I sent to PE. A bit nicer worded etc. I've read a lot about them being much more lenient than the actual firms themselves.
 
The three main points I argued were...

..the ultimate reason for such overstay was A BROKEN DOWN VEHICLE.

Within the car park, the signage erected by Parking Eye detailing the conditions of parking are NOT OF SUFFICIENT HEIGHT AND SIZE for drivers to recognise the vital information when parking and to then adhere to.

and

The amount of the charge demanded by Parking Eye is DISPROPORTIONATE to the loss incurred by Parking Eye and is punitive, contravening the Unfair Contract Terms Act 1997.

That was the gist, it was padded out with a lot of justification and quotage from regulations that parking companies should adhere to.
