Neighbours Leaking Roof Causing Damage Advise

I was hoping someone could offer some advise on the following situation.

I recently bought a property which unknown to me has a fairly major damp problem (since found out seller was painting walls on a weekly basis etc to hide the issues when viewings were happening)

We established that the damp was caused by ingress of water from the roof. When it rains hard it runs down the walls. I've had to remove all the plaster and expose the stone behind as it was wet through when it rains hard. Have several types of fungus growing on the walls including mould which cannot be good for our health.

Also we cannot decorate quite a few rooms in the house until this is sorted.

This is where the issues lie. We have had a few roofers out and the main issue lies in that the neighbours property needs a whole new roof along with the valley between the two houses re doing (shared cost in the valley)

The neighbours are elderly and cannot afford to fix it currently. They say they will be able to in time but realistically i need this doing now not in 12 months time.

The neighbour has to go into the loft to empty buckets of water when it rains. Again not ideal for them as both in their 70's.


Not sure what to do. Surely there's some kind of help available to them. From what i've read on the internet there is but hoped someone who has/had this issue could share there advice or just anyone in the know.

Do they not have any buildings insurance?
Apart from that I imagine you're out of luck without offering to foot the cost yourself.

Yes I did. Surveys are in the most part useless when you have a seller like mine has turned out to be.

They can't move anything. Can only pick up on visible issues. Issues not visible when constantly painted over (which he was doing) and its not raining.

Basically he pulled a fast one. Not sure if theres any legal route I could follow against the seller. I have evidence in the form of a witness where he boasted about knowing the extent of the issues and covering them up from potential buyers using various methods.
 
Can repairs not be made to prevent leakage without replacing the neighbours roof?

If it's failure due to lack of maintenance, then their insurance wont cover it.
 
What sort of survey did you ask for?

If it was a full survey, I'd ask them to come back and explain why the damage wasn't found.

The whole reason you employ a surveyor is because they're trained to spot issues your average person wouldn't, and they are paid handsomely to do so. It's to stop people "pulling a fast one".

Failing that, you really need to persuade your neighbor that this is a priority. Water causes untold damage if left untreated. Get a quote for the full job, and then ask if they have family members that might help them foot the bill.

Last possibility, contact your insurance company. They will come round and asses the problem, and if it's your neighbor fault, they might pay out and take the issue up with them. Check if your neighbor is insured first though, as this will make things easier, the insurance companies will sort it out between themselves.

I personally would be going down a very illegal route if i found out someone had done that to me and then had the gall to boast about it.
******* hate people like that.
