Aranging own courier for ebay win

Just won an item on ebay. Put in a lowball bid and didn't really expect to get it, so didn't bother reading the auction fully.

Anyway, the item, a bike frame, was collection or buyer arranges courier. I'll probably pay by Paypal.

If I arrange the courier and the item arrives damaged who is responsible? I would imagine I would still be able to lodge a claim through ebay? Or does the fact that I've arranged the courier absolve the seller of any responsibility?

As I'll have arranged the courier isn't the seller screwed as he won't me able to make a claim for compensation if the item does get damaged or goes missing?
 
You are making the contract with the courier therefore i would have thought anything goes wrong, you sort it out. You are ok.

Would be a courier claim... Not an Ebay claim... receiving a damaged item would still be receiving it, down to you 2 to sort out.
If it dissapears, you claim through courier too.

Wouldn't it only be an Ebay claim after you received item and it wasnt as described/faulty ?? (leads to courier insurance claim via you)

I'd imagine any claims for damage in transit would be between you and the courier. The guy doesn't want anything to do with shipping, so it's not his fault if it goes wrong.
 
The courier is acting on your behalf by picking up your item, so if it's damaged in transit it's between you and courier :)
 
What gave you the impression that you'd be able to hold the seller responsible for issues with the courier that you arranged?

I'm surprised they are allowing you to send a courier to be honest, since you aren't paying for their time to be available or to handle packaging.

Probably because so many people complain that ebays terms are heavily skewed in favour of the buyer.

What if the item is not as described? Ebay and Paypal will wash their hands of it because I'm the one who emailed the courier? Doubt it.

This is just ridiculous. They stated in the auction 'buy can arrange own courier'. They didn't mention anything about an hourly rate.
 
Depends how it's not as described. If it's smashed up or dented then that's between you and the courier. If it's rusty then you'll have to courier it back.

Edit: It's not ridiculous at all, hence why I was surprised it was an option. Having someone else arrange a courier is hassle every single time, it doesn't matter how clear you are about something being collection only, there is always someone who expects you to wait in, package and label an item to be collected free of charge.

The seller should not be allowing paypal + collection. Can get in a world of pain.

Cash on collection only. You inspect the item on collection. Once transferred to you or your agent, that's it.
 
Seller seems to be insisting that I arrange the courier. I'm arguing that it suits both of us if he organises it.

Also had a read of the PayPal user agreement. I appear to have the same rights as a buyer no matter who organises the courier. So if something goes wrong I can launch a claim through PayPal, and the seller would have to claim through my courier. Good luck with that.

I'm pretty sure PayPal would disagree with that.

Fair enough you arrange you own courier, item is accepted then damaged in transport, how is that the sellers fault, it is clearly the courier!

If the seller organised the courier that would count as 'postage' IMO so why did you bid for an item saying collect or arrange courier??

says it all really, tbh he could leave you to arrange the courier, if you dont he keep monies, sounds fair in the circumstances

So are you not familiar with PayPal terms and conditions? If an item arrives damaged I have a claim against the seller. Does me paying for the courier change the PayPal user agreement? That's bizarre you think that.

So, what are you on about? Does it have any basis in fact or is it just you using 'common sense'?

Defensive? That's a big generic and meaningless.

Yes, I got some opinions, but no one seems to understand that me paying for a courier does not render a legally binding contract unenforceable.

I can link to the PayPal user agreement and that renders all advise completely worthless.

"I'd imagine" doesn't really cut it, benjii. Was hoping for some responses with a bit of substance.
 
Tbh I don't see it as any different to normal.

Seller will still have proof of posting
Of it isn't a described you can claim back off seller or courier


If anything it is getting closer to pay with PayPal and collect in person. Here you can shaft the seller
 
Nothing to stop him claiming item not received however, assuming he has all the paperwork of the courier that he arranges...

"tracking number, what tracking number? Courier went to pick it up and seller told them he didn't have it"
