New consumer rights come into effect today.

I'm slightly concerned about how this applies to things sold in shrink wrap packaging that must be damaged to open it. Will that diminish the value of the product as it can no longer be sold as new?

No because its necessary to open the packaging to assess it. But some retailers will try it on

Packaging doesn't form part of the "product", so destroying the packaging doesn't affect anything.

Exactly. Many retailers already claim simply opening the goods (never mind using them) diminish an items value and reduce, or even refuse, any refund. Some still try to impose restocking fees, even though they shoudln't.

The DSRs state goods do not have to be returned unopened.

The state of the packaging does not affect your entitlement to a refund. This is because the Distance Selling Regulations are based on the fact that the buyer has no opportunity to inspect the goods in a shop prior to their purchase. Therefore, the seller cannot reasonable expect the goods to be returned unopened you should still be entitled to a refund if you have kept the goods in a reasonable condition after opening them.

Maybe I'm being cynical, but I see this modification as open to abuse by lesser retailers.

I agree with you but I think the companies that don't abuse this will benefit from customer retention. I don't always shop on the cheapest price but what I think will be cheaper for me overall in time, cost and effort.

killed DSR abuse not DSR.

Indeed I imagine some will.

So were OcUK aware of the upcoming change to 14 days as well? Is that why you extended your policy or is it just a coincidence? If so how about 28 days :p

Killed DSR? Hardly. Even before today big stores have said you can get a refund if the item is still in condition fit to be re-sold. Nothing different here.
