Iphone 5, faulty camera, tearing images with black and pink lines

Hi so my iPhone 5 is about 120 days past its warranty period and I'm getting fed up with this problem I'm having intermittently taking photos. I have pics that are dated within the 1 year of purchase with this problem so it's not like it happened outside warranty, just didn't think to do anything about it back then.

I have restored, reset, updated and still intermittent.
I called Apple and they told me to take it back to where i bought it, so back to carphone warehouse and they tell me it's chargeable because its over year old.

Where do I stand guys, I would have thought apple would have helped me out.
 
The two year warranty is placed at the feet of the retailer, not at the manufacturer (Apple in this case). They are under no legal obligation to actually assist customers who bring in products bought elsewhere, but the one-year AppleCare is something they give to people as an addition to their consumer rights.

You purchased the phone from Carphone Warehouse, it is their problem to resolve.
 
I'm on my fourth iPhone 5 and all four have had this exact problem, some worse than others. The current phone only does it when the phone is unusually hot. The wife's does it too.
 
Back to carphone warehouse to kick up a fuss. What makes things worse is im tied to a 2 year contract so im paying for a faulty contract phone

Apple store. I showed them the pictures and they just swapped it, no questions asked. They were aware that it is a very common problem. I bought the original phone from O2.
 
Hmm, nearest apple store is 100 miles away.

Went into carphone warehouse today and finally got the manager out, who wasnt much more help but I basically told them about my statutory rights and they said their hands are tied as apple only provide 1 year warranty, I then showed them a link on apples website that they will cover 2 years from a retailer. Long story short I need to get a genuis report stating that it has had an inherent fault since date of purchase then back to carphone warehouse and they will exchange it, they wont touch it until I get a genuis report.

So onto Apple and they are sending me an estimate detailing the work required as that should provide a clear enough explanation of inherent fault. I just hope carphone warehouse accept that.
 
I had two iPhone 5's and both had this problem. Came to the conclusion that the iPhone 5 was apples poorest iPhone yet. Moved on to android phones now and haven't looked back :)
 
You're being fed BS by Carphone Warehouse. Apples warranty is in addition to the legal rights you have. Their hands are not tied at all.
 
Yeah it kinda sounds like that is what they are doing, either that are they don't have a clue! So I'm stuck with waiting on an estimate from apple to then give to car phone warehouse for them to acknowledge the fact there is a fault.
