i am still trying to be reasonable and polite with her.

Firstly I do not do face book so would not receive any messages I also do not live at ********* close so please feel free to send anything there as it would never get to me. Please also feel free to go to the small claims court I have plenty of guest before you went and who are there now that have not complained about builders I will also counter claim from you for the damages you and your guests did why you was there I have pictures and bills to show that I had to replace the damages we made you an offer you refused. Neighbours in lanzarote have also said that there wasn't that much noise and it wasn't for the whole time you was there it was a couple of afternoons if that. Please do not email me again get your solicitor to email me and I will deal with him or her direct.

yes i have her email address, owners direct have emailed her stating a complaint but do not get involved.

She's adopted a boxing stance. Round two should be interesting.

i am open to ideas.
 
Interesting... her husband's business appears to be £10k in the red... wonder if that's why she's being so against refunding you anything... :p

Yeah, I've given the OP her address, which is the one she appears to be claiming she isn't at, despite her being the only person of that name in the area, and the other person registered at that address having the same name as her husband.
 
Could you contact someone living in the woman's vicinity (at her disputed address) to see if they can confirm the identity of the person living at that house?

Do her husband's registered business details give anything away? Director's details usually include their home address. That way it can at least be confirmed she's fobbing the OP off.

Assuming it is actually the husband, then the business details do list the home address as being the same.

It's not a conclusive link, but one of the reviews of the villa mentions a thank you to X and Y.

Now the OP has confirmed that X is the name of the woman he has been talking to, so it's a reasonable assumption that Y is her husband.

Considering there is only one person with the name X on the electoral roll in proximity to the bank branch that corresponds with the sort code of the account the OP paid into, and that there is also a person named Y listed at the same address, it's again a reasonable assumption that it is the correct person.

So either they've recently moved, she's lying when she claims not to live there, or they're renting the property out but still have their names on it (electoral roll shows the most recent update as 2014).

At this point I'm not sure what else can be done to confirm it's the correct address?

You can obtain a default judgement if no response is received.

You need to make sure you're claiming from the correct person though.

It seems fairly likely that the details you have are for the correct person but you don't know that with certainty.

If you don't know the defendant's address you can ask the court for permission to serve the summons by putting an advert in a newspaper or displaying a notice in the court building.

Perhaps you should seek advice before completing a claim form.
