Been refunded & still have item

Give them 30 days (20 business days) to rectify and if they haven't contacted you, I'd say it's safe to assume they're not going to ask for the money back.

Get the name, date and time of any communication as evidence though :)
 
Why would you tell them they put it back, I would have kept it, there mistake.

OP - Similar thing happened to me a number of years ago. I was being paid by an ex employer for six months. Advised them on every occasion until it stopped and a further reminder after.

I would give it a week, remind them once more, then leave it to them. You did the right thing, if they don't act on it then your conscience is clear.
 
People keep telling me how good JL's CS is, but I had no idea they randomly gifted customers their payments back. For a lens, I'm guessing that's a fair amount of dosh too.

About £350, so will glady keep the money if they dont want it back :D
 
Someone can probably find the legislation. But you have to contact them once to make them aware of their mistake, they then have reasonable time to sort it out. I would say a month is enough time for them to sort it out. Probably best finding the exact legislation, just to be sure.

Theft is robbing something what isn't yours, if someone gives something back that is not theft? There mistake. I do have nice morals and know what is theft, that isn't.

I've had a few examples of this.

1. Ordered a £2,500 TV from an online company. TV was delivered, but credit card not charged. I kept quiet, but a year later I get a very angry phone call from the company and got charged the next day. Had no problem with paying for it, but I'm not spending my time chasing someone up. They want the money, they take it.

2. My dads TV from currys broke down. Store shipped a replacement but did not collect the faulty one. He left it in the spare room for six months but didn't hear anymore. He took it to a local repair shop and got it fixed for about £100. That was a good few years ago now.

I think at some point accounts will flag it up and either the managers will write it off, or spent the time and effort collecting it.

You're right, you would be charged with Retaining wrongful credit instead. Usual one for this is the famous bank ones, where the accidentally debit your account with lots and rather than telling the bank you spend it. then act all shocked when you get convicted and a custodial sentence.

What if a company takes out £400 for no reason due to a clerical error, and after NINE MONTHS still haven't sorted out the problem

I don't see why not, why is it taking 9 months. They've been informed it's a mistake they have to sort it out in a reasonable time, talk to trading standards or which ever the relevant body is.
 
You've contacted them. So I'd wait a while with the money in the account in case they had some sort of IT cock up.

If they end up saying that there is no problem, personally, I'd donate the money to charity - but I wouldn't feel guilty about keeping it.

It's just been resolved now thank heavens, but it was hard work!

no idea what happened, but I bought an xbox one on launch day which was paid for.....then for some reason charged me again about two months later :eek:

they kept saying my consoles serial number wasn't the one registered to my name and address or something :confused:

anyway, nine months or so later and I have finally had a refund....and....wait for it......£12 xbox live credit lol

Fine - so if the bank accidentally puts money into your account you'd spent that too?
People goto jail for that.
Not saying there is any chance whatsoever for a £350 issue which the op seems to have. But you need to realise that you cannot just spend/use/sell things you've been accidentally given.
 
It's fine, they contacted me back today and are arranging something to charge me back the money. All sorted :)
 
tel lthem whats happened say i will hold the money for 90 days if you have not contacted me to disscus returning it by then i will consider the matter closed
