What are my consumer rights if I receive an American phone ?

I bought a phone from a UK retailer.

The phone was defective and eventually I got a replacement. The original model was a UK variant but the replacement is an American variant.

I checked on Apple and it seems the US variant doesn't have LTE band 7 which a couple of networks use. Can the retailer get away with saying they sent me an equivalent replacement ? They seem to think it is but it clearly isn't.

Just trying to be prepared here in case they try anything.

Not sure if it counts as a competitor but the name sounds like 'sex' found on the high street.

Not sure if it matters they sell 2nd hand goods. My rights should still be same ?
 
Well as it is used goods you bought what did the description of the advert state? You could argue that it isn't 'significantly as described' if it specifically stated it was a UK / Euro model.
 
It just has the specs pasted on the site. They list 4 different variants but don't specify which one you get.

Surely buying from a UK retailer it would be understandable to assume I would be getting a UK variant ?

Also it shouldn't be considered equivalent seeing as one of them can't do LTE for all the UK networks but the other can ?

I'd be concerned of warranty issues also tbh, if its a US model the apple stores may refuse.

Have you spoke to them and asked for a UK spec one?

Well apparently some people get excited about new phones, not sure what they got excited about before mobiles came out, so they would be a good prelude to sex.

iPhone 5s. It showed A1533 on the back.

They will be replacing it now. Took a lot of complaining though.

Warranty concerns aren't an issue as Apple care will cover most things. It's only if it's damaged out of the box the retailer has to sort that out.
