2 asus 670cuii in sli problems one top version ?

I'm having weird scaling and allsorts of problems in sli.

I have two 670 DirectCU II in sli one is a top version one isn't is there any way I can flash the other top a top version ?

Yes, you can flash on Ebay, or in Afterburner
And seriously&strictly saying - what "allsort" of issues do you mean ? Cards don't have to work at the same speed in SLI since long time, so different speed is not an issue here. For your peace of mind - you can try do downspeed TOP version, or upspeed normal version using above mentioned Afterburner program = and see if that changes anything. If so - theoretically - you can flash normal revision with TOP BIOS further, but nobody smart wouldn't recommend it as TOP revisions are preselected chips and whoever-knows-what-else (like different PCB = more power phases, better cooling etc) which may cause simply faster chip degrading, unstability or even whole card damage. Graphic card overclocking is good for a while (playing), and not for longer - like BIOS flashing IMO.

was the same with my wf 670's. Also with the cards in sig which are two different revisions of the wf 780.
