The problem with that of course being that it's virtually impossible to prove consent/motivation in a case like this

Not really as we have a video? Did his penis become erect while it happened, if not then it's probably not for sexual gratification.

We don't the video so it's hard [no pun intended] to tell but I'd wager this was an act of drunken laddish "lols" rather than an act of foreplay.
 
Quite, which is why I am, as I said before, conflicted.

Ultimately, the law has to be stern to dissuade people from acting in that way. Any lesser sentence would undermine its purpose, so I can't begrudge it.

Sucks for the villain though.

It gives me a good idea for a thread - if you were caught for the worst criminal acts you had committed, what would your sentence be? :p
 
It isn't funny by any means, but I don't think it warrants a custodial sentence.

How many times are we assured that the purpose of prison is rehabilitation of those who would otherwise pose a threat to the public at large?

I think the utter destruction of this chap's previously promising future is more than enough for him to get the message. Now they're just kicking him when he's down.
 
A criminal record for the rest of his life which will ruin his career and stop him getting good jobs and 9 years in prison. Come on. As if thats a fair punishment. Have you people ever been to a house party?
 
That conversation to whoever she reported it to must have been funny, sorry. I woke up and he slapped me with his penis and all his friends were laughing. hmm. I guess she didn't see the funny side to it, some people may have. It depends on the context to be honest. In this sort of instance details matter in my opinion. If it is a house party and people are at it all over the place and some guy makes a joke like that and this is the outcome then i think it is an over reaction. The video i think though may have been the only reason it ended the way it did, as then it has the potential to become humiliating.

Often it is the parents that over react when they fine out and go to police, once police find out about it, they just like robots and treat it like a serial killer case just be cracked and take it all the way. I am surprised they didn't put him on the sexual predator list.

I get wasted 2 or 3 times in a year, but I do it in the company of 100% trustworthy people who have proven their trustworthiness and who I know will protect me (as I will them). I'm not defending anything or anyone before someone misinterprets my stance. If anyone did such a disgusting thing at one of our house parties they'd get beaten to a pulp and thrown out within three minutes - if she wanted to let herself go she should be doing it in the company of honest people.

I'm just saying ****s will always be out there, you have to have some major naevity about you to be able to trust that a bunch of random drunkards are going to protect you if/when you pass out.

If anything the sentence is not enough. The fact that his career is now ruined will hopefully act as extra punishment.

Yeah man, we should also support making it hard for people released from prison to find jobs and increase the likelihood of them re-offending, yeah!

is it not rule 1 of pranking not to prank someone who isn't going to take it well?

besides, in my book thats not a prank, pranks generally require a bit of preperation and lateral thinking in order to be funny, this is not funny and didnt require any thinking.

if he was going to do anything, the bucket of cold water/good old drawing on the face would be pranking.

from that i'd say that the concept of police getting involved is correct, wether or not the sentence is proportionate depends on your view of the justice system. i guess the judge probably saw an easy target in terms of getting a conviction and slapped a big sentence onto it to make the law look like it works.

If I choose to get so drunk then decide to stroll home through other people's ghettos I have no one else but myself to blame if I get mugged. Because the mugger will always exist.

I don't know why people think they can actually let themselves go like that without fear that anything bad could possibly happen. That's unrealistic, not rape culture. Just like muggers, perverts and rapists will always exist. Men take precautions to minimize the risk of getting mugged every day, why couldn't this woman take simple precautions to ensure that the people she was allowing to be in control of her unconscious body at were at least trustworthy? If you go out with a bunch of ****s you're going to get treated like one.

I don't know if it's just my heightened paranoia. But then again it just proves what I've been saying all my life. Alcohol=terrible thing, weed=great thing. Imagine she was high on weed, she would have been paranoid about how much she can actually trust them. Paranoia has saved my life on multiple occasions.

What you're saying IS understandable, but it's a mere gnat's pube away from becoming "Well, if she dresses like that then she's asking for it..."

There's "asking for it" in certain situations -- such as walking in known bad neighbourhoods as you say, and then there's situations like this. Whilst you could easily expect being punched in the face and mugged by some rudeboi, you don't exactly factor penises in your face as a possible outcome when making those internal risk decisions on a general basis. Unless you're on a porn set or something similar.

EDIT: The weed thing is nonsense, though. At a toke party she may be just like me and white out before you know it. Then the other **** may think it's the funniest thing in the world in their Mary'd-up minds to teabag her forehead and all sorts. Doesn't matter what the substance is -- if you're a piece of ****, you're gonna act like a piece of ****.

wow the replies in here really shock me, one little mistake at uni and pretty much ruined his life.

I would love to know what you did in your early 20's

community service yes. but jail time for this is pure jokes, if it was in the streets fair play but it was at a house party so no doubt everyone was smashed and not thinking straight
