Because it changes the likely motivation from something sexual to simply trying to get a laugh out of your mates. Yes, the act is the same but the impact on the victim would probably be different. The sentence should account for this.

Why? Sexual assault is defined as sexual assault based on the acts involved not the intent. In fact, a sizeable proportion of sexual offences, up to and including rape, are carried out not out of any sexual motive but rather to humiliate, subjugate or punish the victim or their partner/relatives - have you never heard of the concept of a "punishment rape"?

Dude slapped his dick on her face to sexually humiliate her for the amusement of his mates and filmed it. He totally deserves to be punished for sexual assault.
 
Quick straw poll. How many people in this thread who think it was just banter, or a prank, and just something that happens at these parties, are female?

Also would these same people have the same thought if it were their daughter?

There are only about 5 "outed" females on OCUK (as far as I've noticed), you're not likely to get the female point of view here.

But if it were my daughter. Or son. Or mum. Or me. I would still find it funny, if I'm honest. As long as it was just humourous a slap or two.

Context is important, though. If the slap-er is being nasty, or demeaning in a sexual way, then it's not funny and is just bullying (or worse). But if it's all pretty light hearted and jovial, then I'm all for it.
 
I think it was a bit harsh but I suppose it comes down to the circumstances. If they were friends then it does seem like a bit of banter, as stupid as it was.
If, however, they didn't know each other then it goes from a joke to extremely creepy.

Doesn't matter what the reason. But you have to wonder what is going through someones mind when they choose to 'prank' someone with their wang. I mean, even if it was a harmless joke (which, if they expected her to take it lightly then they're retarded) then he could've picked a better idea than to whack out his schlong and record it.

Also, they recorded it. How is that not proof the goal was purely humiliation? :confused:

I abhor violence and find such behaviour lamentable however if someone did that to a member of my family, or even a friend and thought it was unacceptable I'd be quick to reprimand that behaviour. However I find these sort of pranks pretty immature and frankly pathetic.

Knobs are funny - that's undeniable. slapping someone with a knob is funny - that's an opinion.

The recording was by a third party. Everything gets recorded now. It's proof of nothing.

The reason definitely doesn't matter to him now.

And 'having a laugh' with mates who have a similar sense of humour to you is different to slapping a girl the face with it when he (clearly) didn't know(or care) how she would react.

Though it's true that the third party could've been recording and just happen to catch it.
