9 months is, i think, a touch on the heavy side. people have spent less time in jail for killing someone whilst on their mobile in a car for instance.

i would have made him do 9 months of community service.

And 'having a laugh' with mates who have a similar sense of humour to you is different to slapping a girl the face with it when he (clearly) didn't know(or care) how she would react.

It all comes down to this. Know your audience. I know out of my mates who I can slap round the face with my penis, and who I cannot.

Short answer: If you're going to be a **** make sure that it's with the rest of **** friends rather than with some unsuspecting woman, otherwise, quite rightly so, you could screw yourself over pretty badly.

Alright mynight, I'll rub my genitals over your face. No homo - just banter, mate.

Huh? I didn't say it was ok did I?

I'd be ****ed but I wouldn't expect you to go to jail for it(maybe I'm too lenient). Clearly I was wrong and it is a sexual assault in which case it seems an adequate punishment.

Yes its worth 9 month in jail, is it worth discussion as to whether this was too much? No

If the students dream job was to be a solicitor then he should have known better...

I do think though that the OP has done this himself and is now very concerned!!!

So on the basis that its not a sexual assault as some people are arguing, if a random guy slapped his knob on a sleeping 8 year olds face "just for a laugh" without any sexual motivation, would that equally not be classed as sexual assault?

Banter is a ****ing horrible word and people who use it are hateful. People who use it to defend stupid actions are even more hateful. Like those retards "pranking" people on Youtube when they're just being ***** and end up nearly getting their asses kicked while screaming "it's a prank, it's a prank". It's not a prank. It's not banter. It's being a ****.

+1

Not sure that would be classed as a prank...its more of a weird @#$$##$ needs locking up.

But what was the guy thinking....personally i dont find being drunk an excuse to get away with actions which would normally get you locked up.

But if it's not sexual assault, then why would the victim's age make a difference?

If I have sex with a 25 year old woman consensually then no crime has been committed. If I have sex with a 12 year old girl consensually then I've raped her.

Why should age matter when the rest is the same?

That's your argument reversed.

> Implying consensual sex and slapping someone with your todger can be compared :p

Also, that's definitely an over simplification. Context is important.

I'm not saying it's not a sexual assault but i guess it's not just the action itself which is taken into consideration.

Walk into a football teams locker room, strip off and join them in the showers would probably be seen as a prank.

Walk into the boys showers at a school and do the same...it's pretty certain you will end up on the sex offenders register.

This ^ gave me food for thought. A good post.

But, having considered, I think the "wrongness" with the 8-yr-old example would be in the "adult" nature of the joke, rather than it being an overtly sexual action. You wouldn't talk about having a threesome, or a recent beheading in the company of an 8-yr-old either. Similarly, you wouldn't take the [pee] out of an 8-yr-old in the same way as you might a fellow adult.

Is there any risk of transmitted infections by slapping your rod in someones face? I'm not an expert but there might be a risk?

The question I asked earlier and no-one who says it's just "prankish" has been able to answer is that if there is no sexual context why was a sexual organ used and the same for teabagging etc. That body part was used for a reason - not for gratification - but as a symbolic representation of the undertones.

Herpes will be one of the more obvious ones. Risks both ways there.

.

Because knobs are inherently hilarious.

Plus, there's the fact of it being drilled into us from a young age that it's a bit naughty to get it out in public. Just adds to the giggles really.

E:
plus, it seems a bit "urgh". Much like licking someone's ear; also funny
