even judges are getting fed up with the drunk rape cases..... I remember a judge saying in a oxford paper that until ladies stop drinking so much out at night there will always be trouble with rape, most are so drunk they cant even remember what they just said (not alway the case) anyway... she should be grateful one of the lads didn't have the idea to give her a golden shower..... unlike some poor sods :(

Do you know what prison is like for someone with an IQ above room temperature? Of course you don't, but I'd wager that you know your way around the comments section on the Dailymail website.

Not sure which is more stupid, doing it or allowing it to be filmed. Obviously the former is plain wrong, but on the stupid scale both are about on a par.
 
What punishment would you suggest then?

For example what about kicking him out of Uni and making him pay a £50k compensation to the woman?

yes yes im sure she's living in fear and was recently diagnised with PTSD because of this.

This is stupidly ridiculous.

Stupid **** like this is blown out of proportion, there are a lot more serious issues to deal with.

I think hitting a stranger in the face with your penis constitutes an offence that should deserve jailtime, no matter who the stranger is, or the circumstances in which you find them.

Exactly. I would expect to spend a few months behind bars if i went up to a random woman in the street and started touching her with my johnson. Especially if i had a friend film it and distribute all over the place.

Do people think this should be allowed. Seriously? Those of you defending this guy, do you think men should just be able to do this to random women with little or no consequence?

I think jail time is a bit harsh. Not all crimes deserve a custodial sentence. I think getting booted out of Uni and a fine would have gotten the message across here. When I was at Uni I attacked and injured a guy with a knife while blackout drunk (yes, very messed up I know) and got a £250 fine and was moved to different halls. This dude goes to jail for a very tasteless and unpleasant joke. It doesn't seem proportionate to me.

Sounds like you just got lucky that the guy you attacked didn't take things further to be honest.....

There are plenty of guys getting away with suspended sentences or less for knocking strangers out a punch on a night out. But hitting someone with a penis is more "emotionally damaging" than breaking their nose with a fist, so that'll be 9 months sir.
 
Victim shaming? I would say its saying the woman should take responsibility for her own actions.

Take a friend, don't get so hammered, or leave and go home instead of sleeping around loads of uni lads. Easy options to not end up in a situation where someone can get their shlong out and whack it on your face.

Maybe im less than sympathetic as i've woken up several times in, less than "ideal" circumstances shall we say, but the only person I blame is myself for not drinking more responsibly.

How about taking responsibility for your own actions and not poking someone in the face with your ****?

That's like a bank being robbed and someone saying "Oh shouldn't have had your money with that bank. That's definitely your fault."

Personal responsibility is a two way street. Be an idiot to the wrong person, and you'll end up in jail.

Aaaaaanyway, there has been some genuinely interesting discussion in this thread about the prison sentence and selective justice and this I find far more interesting than people's opinions on the crime itself.
It's a (clearly) very emotive subject for a fair few people and I'm not an expert at all so I was pretty much "He's a ****, let him hang" but now I'm wondering, is making an example out of people by giving them a harsher sentence really the best way to maintain a fair legal system?

Were the police involved, or did the uni keep this an inhouse matter?
I am assuming he didn't press assault charges and you were never actually prosecuted and taken to court? If you were what you got was amazingly lenient.

There is a world of difference between two guys having a scrap, or even one guy hitting another for no reason compared to videoing yourself shoving your penis in an unconscious womans face. I'm amazed that even needs pointing out.

The sheer amount of posts in here implying that it's all OK, she should have expected it etc. is worrying really. I just cannot fathom how someone could rationalise putting their penis in an unconscious persons face as if it was the drunk persons fault for being asleep.

How about people just don't shove their penis in other people's faces? :confused:

I think the issue is that people seem to be thinking that they were all mates and that the guy knew the girl. Or at least they are comparing it to a situation like that.

The relationship between the two parties is the most important thing to consider here.

Of course the police were involved and it went to court. The chap was understandably shaken up by the whole thing and wanted to press charges. I was given a deferred sentence and it probably worked in my favor that he and and his friends filled me in outside of a nightclub in that time. I agree that I got off quite lightly. But it was enough. That's the point I'm making here. This guy did a really stupid thing, but he was probably drunk, didn't really think the whole thing through, and being expelled from Uni and fined would have probably been sufficient to stop him from penis slapping girls in the future.

For the record, I'm not the one saying it was the drunk person's fault (that's another discussion going on in this thread) and I do think the guy should be punished, but not given prison time. Most of you have no idea what prison is like, especially for someone who isn't your everyday smack head/mugger/GBH repeat offender. Depending on his character, he might need counselling, anti-depressants, might even come out a drug addict given that 80% of prisoners take illegal drugs.

Answer me this: if you expect to go to prison for this, why isn't the prison system full of "t-bag offenders"? Because this sort of "prank" occurs all the time. Shouldn't they all be in prison? Once again, my problem is with selective justice.
