Chaning car owner with previous owner deceased query.

Hi guys, just a query as I'm not sure where I stand on something:

My Mum bought an MX5 about 3 years ago, and sadly died just over 2 years ago, the car was in her name, and its insured under an Admiral multicar policy with my Dad's car. He's been using the MX5 on & off and has decided to give it to me, but the log book is still in her name and the car is insured under his name, do I call DVLA & query this or just fill in the log book with myself as the new owner and send it off?

Don't wanna get it wrong either way by calling them for no reason or not calling them when I should, really my Dad should have 2 years ago but doesn't seem to think it matters!

Anyone been in a situation similar and could point me some guidance?

i have heard of people just signing the bottom of the v5 with the new details on it as its only a registered keeper, not the legal owner document.

That's what I was thinking, but it's more the signature part, too, knowing my luck I'll get something come back on me!
 
I have just done this with my father passing away. Follow the link above, specifically the second page about keeping the car. Essentially it's just like transferring normally except you don't get the registers keeper to sign it obviously, you provide a covering letter and you address it to t he sensitive case team rather than the normal address. New V5 gets issued in whoevers name you want.

Thanks BigT, I was only worried about doing so with the car having been in use since her death & no change on owner at that time, I'll send it over with a covering letter asking them to contact me if they need any clarification etc.. and see what they do from there.

You don't have to state when she passed away nor provide the death certificate so I think you'll be in the clear. The only way they may check is if you let DVLA know about her death for the purposes of cancelling her license but I doubt they'd do that and I don't think any sort of offence has been committed in any case.
 
The DVLA were one of the few institutions who were simply superb when my dad died. Give them a call, they'll explain what to do. We just filled it all in, and did a covering letter. They were fine and no issues.
