Ebay & paypal just not worth the risk anymore

They can't update your credit file as you haven't entered into a credit agreement with them surely? They intentionally avoid this as they don't want to be bound by credit legislation.
The debt collectors job is to get you to enter a credit agreement.
It's the same process the TVL goons use. "Confirm who you are and sign here please."

You close both of your accounts and cancel all bank details
Ebay will get the money from Paypal
Your paypal account will go into negative balance
Paypal will chase you for the money
They will get their money from a third party
Baliffs come round to your house
You get a black mark on your credit report

How do I know this? Same thing happened to me with a similar ebay scammer

Yet when I sold a phone, complied with all the requirements of seller protection, and the buyer tried to scam me, PayPal sided with me and I got to keep the money...

180 day buyer protection doesn't automatically mean buyers can get away scot free. A broken phone would not be covered by it. That scheme is for significantly not as described items or items not received and is a way of reducing the number of chargebacks through credit card companies.

So much nonsense on this forum about PayPal/Ebay.

Interesting, please let us know how it turns out.

I was thinking yesterday I'd like to sell my speaker set and buy something better, but ebay is so commercialized now it is almost pointless. If I make a fiver after fees and postage ill be lucky.
 
Ebay/paypal absolutely do sell the debt to a creditor and then they will follow up the debt with letters, threats, visits etc.

How do i know? Because it happened to me over fees from a listing, about £50 quid.
I met the buyer in person and he paid cash. Ebay wanted their cut of the "sale"
I thought id get away with it, the bailiffs said otherwise.
This was a long time ago !

i'd never sell on Ebay again. I happily buy always from " i am a shop" type people.
 
Those aren't bailiffs they are just debt collectors who can't actually do anything. A bailiff works for the court not a debt company.
 
The whole thing stinks the way paypal deal with it, you would think by now they would notice a trend of people trying to claim money back on expensive items just before the 180 days is up.
 
Basically, what has already been said.

Remove debit/credit card information from them, direct debits and all.

You can kiss goodbye to selling on ebay again. (Not that you'd want to, however, after this). Some people have risked setting up a new paypal/ebay account but it's not frankly worth the risk any more.

Ebay & Paypal will always back the buyer even after months of purchasing an item, I had a similar problem a few months ago with a 7950 the buyer put in a claim in after 4 months saying it didn't work and didn't have time to test it because he was away working what for 4 months!!!!, Anyways i got the card back without a static bag and bits missing and a battered up box, he got his money back.

Do you still have tracking number for the phone?

You just need to upload and show proof of receipt but positive feedback will probably do.

I don't think they will side with him. Surely not.... that would be outrageous.

Just speak to paypal and explain the situation.

What have you seen happened specifically?

They can't just "recover" money. They put your PayPal account into negative balance and then request the money from you. If you don't obligue, there's little they can do other than sell the "debt" on. There's little they can do to actually recover it because of the circumstances under which the "debt" was created in the first place, ie at PayPal's discretion.

Also, you never did mention why you're talking about credit records and bailiffs.

I did this. Someone tried to scam me so I pulled all my details from paypal, cancelled my debit card so they couldn't charge it and basically told them to **** off. They sent debt recovery letters and I just ignored them. I literally did not care one bit because I was so furious. Norhing came of it, but in the situation op is in I would still advise trying to sort it out properly and if it fails just do what I did op.

Screw being out of pocket. Let paypal eat the cost if they want to enforce something so utterly disgusting.

There's only one place to sell a phone and it's the MM, amirite or amirite?

Sadly with items like these ebay is just a no go. More crooks out there than worth the hassle. Gumtree to some extent is better, you get paid cash on collection, there's no claiming fault 6 months down the line this way.
 
i wouldn't like to sell those sorts of items on ebay these days. no real protection. and too many chancers. i used to sell on ebay and make a decent amount each month and that was with items that didn't have moving parts, and weren't electrical. now though, you are too exposed. stick to the members market.
 
Update on this post.

I got the phone back it was scuffed up and the screen was cracked plus no box or items looked like it been dropped a few times, when i originally sent it off there wasn't a single mark on it this phone, I sent ebay pictures off what the phone was like when i sent it off and what it was like when i got it back, but got some automated email saying pictures can not be used as actual proof in a dispute.

Tried to get in contact with the buyer and wasn't getting any replies from him funny enough, plus also phoned ebay which where no help at all all they kept saying is the item been returned to you & now i have to refund the buyer, told them it was nearly 6 months ago when i sold this phone they just wasn't interested just tried to make me out to be some kind of liar.

I've now blocked Paypal from getting into my account, with both ebay and Paypal silly policies they just paid back a scammer nearly £500 & won't be getting a single penny off me.

This is an all to common problem now with ebay you think they wise up and change the way they work rather than just backing the buyer all of the time, then washing their hands of the problem, and leaving legitimate & honest sellers out of pocket.

I haven't used ebay in a long time, the sheer amount of negative threads about ebay and the silly rules they have make me glad I no longer use it.

So many scammers and they don't seem to give a damn about it.

OP, I've just done a similar thing

My paypal is negative £200 and I have removed all my bank details

Monitor is coming back today with a part missing, and I have no intention of giving a refund
