Tenant complaining about us charging him for a new mattress

We have a student that moved out about a month ago and we've only just got round to inspecting the room. That's when we found a stain on the mattress.
He denies it was him but the mattress was brand new prior to his stay!

Are we right in charging them for a new mattress?

I mean sure, I guess the next tenant wouldn't want to sleep in someone elses jizz stain, get it cleaned and yeah it's been a month; who's to say someone else hasn't been there even if you say so?

How long were they there for?

You don't get to replace old for new because someone has used the property. To me, the odd stain on something like that is fair wear and tear, especially if it's been 1 year+.

Edit: I should read the rest of the thread (and it's counterpart) before responding :p

Actually, peeing on a mattress is not considered wear and tear. ;)
 
Can you prove that the mattress was brand new and stain free before he moved in?

Can you prove that the stain wasn't caused by something between him moving out and you doing the inspection?

Can you not have it cleaned instead of buying a new one?

I'm assuming you've returned his deposit in full already since he moved out a month ago?

I'm guessing you may have to (rightly or wrongly) take this one on the chin

Just clean it and charge him for the cleaning? I don't think you can replace the whole mattress because of one mayo stain. If he had damaged the mattress, to the point where it was not usable then sure. Can't you just turn it over?

Ahahahaa - such a small world

EDIT: Darn right I'd charge for taking jizz stains out of a mattress!! - dirty little beggar. Factor in your time, any additional vehicle you have to hire to transport it etc, and it'll soon be cheaper to just replace it the tenant will agree.

Any real landlord would know precisely what to do in this situation.

1. Find cost of new mattress.
2. Double it.
3. Take money from deposit, pocket it.
4. Turn mattress over.
5. Get new tenants.
6. Practice Tory voter evil laugh.

Would more options work?

7. When tenant leaves, turn mattress back over to original state.
8. Repeat from step 1.
9. profit?.

you want to charge someone a full price of an new one for an stain barely noticeable, your having a laugh ain't you. its your word against his and his against yours .an simple 2 min steam job and it 's good as new for what i can see . i tell you what when i want to have a good laugh i just turn to ocuk general discussion section of the forum and read what some of these op's have posted. really ocuk should change the heading to comedy section :D:D:D:D:D:D:D:D:D
