Being ripped off small claims advice

You have no grounds for a claim. You had the opportunity to check it over and you even said it was working when you took delivery.

Think of it from the other side, you could have done anything to the bike in the time that you have had it.
 
How long did you have it from the sale, to the first ride on it?

I agree with others - unless you can prove, beyond doubt, that the faults were present at the point of sale - your claim will go nowhere.

You said it was running when he sold it to you. You stored it, it then didn't work. No much chance.

Chalk it up to experience, try and sell it for £250 for a "project bike" to someone.
 
Google '50cc mbk nitro starting problems' there's a few things you can try. I would start with the air filter, see if it's clogged up/filthy.
Could also be that the electrics have been butchered at some time in its life, so check connections and wiring too.

How do you know it just wasn't a flat battery, how do you now you didn't damage any wiring / connections when fitting the battery, fuse.

The speedomiter would be £50 repair, dashboard lights another £30 (altho said dashboard may need replaicing and that would cost hell of a lot more). Why would the dashboard need replacing was it all bashed up?
I think the garage didn't want your custom and just plucked some numbers out of thin air.

What model is it?
 
I don't think you will get very far with this. And it's CBT which stands for Compulsory Basic Training. You cannot really "pass" the CBT as it is not a test. CRB is a Criminal Record Background check.
 
Your best bet is try to find a reputable garage and get it mended. I can't imagine you'll get any joy from the courts.

Sort of reminds me when I went to buy a car once. We went to see it twice (I say we, there was three of us). We scoured the car for any possible problem we could imagine. Ended up buying it, got it home and realised it had 4 completely bald tyres which none of us though to check! lol...
 
To me the price paid would be consistent with it being a spares or repair type job, similar fully working machines seem to be in the £500 to £600 area.
Check the battery to see if it's gone flat since fitted. Most of the problems you listed including even the speedo could well be down to a dodgy magneto or voltage regulator.. Not enough charge being produced to run the bike.
Most of these 50cc peds will at some time have had some boy racer try to get more speed by messing with carb jet sizes, exhaust, rollers etc. so could be anything but electrics is first suspect and you should first confirm you have a spark at the plug.
I can see you are short of cash so are any of your kids teens with mates who are bikers? Try to find someone who messes with bikes for fun and ask for help. Garages/bike shops will stitch you up for even basic stuff.
You aren't going to get anywhere through the courts I'm afraid. I hope you manage to get it sorted, I appreciate you aren't well off and some comments you get on here can be pretty heartless.

You have bought a whole vehicle for little more than the price of a routine service.

At that price you will have bought a "Project" not an example of guaranteed, practical, no problemo, ready to roll, daily transport!

Suck it up and get real for heavens sake!

(When I buy cars/vans I buy cheap (up to a grand) but I always regard them as "projects" and will accept that I am likely to have to spend at least as much again before I will regard them as being roadworthy what ever the previous claims might have been made by the sellers!)

This thread sort of reads like the worst examples of "Thats Life"

(I paid £150 for a 18 year old Ford fiesta and 8 months later the tyres worn out, I HAVE BEEN SO CHEATED! :) )
 
Ok, first off, an MBK Nitro or Yamaha Aerox as they're more commonly known, doesn't need a battery to run. Very few 50cc two strokes do. I tinkered with tons of these things for years so I can safely say I know what I'm talking about.

Remove the soark plug first of all and inspect it. If it looks old and knackered, replace it. Then whilst it's out of the head, put the cap on it and ground it on something metal nearby, must be bare metal. Hit the starter or crank the kick wth your hand slowly. It'll be easy to crank as the plug will be out so you'll have no compression.

BE CAREFUL. DO NOT TOUCH THE PLUG ITSELF OR YOU WILL SHOCK YOUSELF. ONLY HOLD THE PLUG CAP.

You need a clean blue spark. If it sparks to one side or tje spark is in any way orange, replace the plug. NGK do some good two stroke plugs for a fiver or so.

If the cap doesn't fit nice and tight, replace it. You can simply unscrew it from the cable and screw a new one on.

If it sparks nicely, the ignition is fine in which case it could be a magneto coil, but try that first to eliminate it and report back.


I got 22bhp out of an Aerox once. Mental didn't quite cover it :p
 
Judging by this thread, your ad on facebook isn't exactly honest...

I got the bike running this evening mate. My add on facebook is honest the bike does run now but needs a bit of work. it even states in the add that the bike needs work. The person who sold me it has obviously taken me for a ride sold me it saying it needed no repairs and has no issues.

Dont matter now sold for £180 sold at a loss but could been a lot worse. i am fortunate enough to have good credit so going to look into getting a new one on save me having issues again.

seriously is this an old bike like 80's/90s?

motorbikes of old are incredibly easy to fix you don't need mechanical knowledge if you can build a pc....
 
It would have been illegal to test it. No licence tax or insurance

when i boguht my first bike i didnt have the insurnace ready so i just said "can i hop ton the back and we just go through the gear etc" 5 miniutes pillion ride he goes through all the gears shows the breaks acceleration some handling brilliant job done.

most of the issues will have probably been chase down corroded earths, check ables, clkean and oil ****ing everything check carbs.
