Sold a 7950 end of June, prompt payment from buyer

6th July - buyer opens a case. Where's my card...
8th July - signed for by buyer
13th July, case closed in buyers favor, full refund issued by eBay.

I found out about this on Monday when my PP account was -70 quid!

Should've checked eBay but that's by-the-by... I've been in touch with eBay through the appeal procedure and they said tough luck. Ask the buyer for the money directly. Yeah because that's gonna happen!

I've opened a case with PayPal, explained everything and gave them the tracking details. Hopefully they'll suspend the money his end too...

MyHermes confirmed that it was delivered at that address, not a neighbour or something so they have done their bit.

I thought it'd be a clear cut case through eBay but apparently they are top notch ******.

Absolutely stunned!
Where do I go from here?

I know this isn't exactly helpful, but considering how many eBay threads get posted in GD where sellers have been screwed, why did you sell on there?

I really lose sympathy.

Oh come on GD!

You posted it to him, therefore he has a letterbox, no?

Edit: And am I the only one who hasn't been scammed on Ebay?

I have videos of the card working and being removed from the system
Pictures of the serial numbers
Proof of postage
Insured for the full value
Required a signature

Thought I had done everything... My first scamming too, looks like poo through his letter box is the next best thing

No, doing everything involves not selling things like that on ebay and using the MM here instead.

This ^ really. No idea why you'd sell on Ebay when you can get about that much from the MM. Given the ~15% combined Ebay/Paypal fees, the MM prices being maybe slightly lower shouldn't be an issue

More usefully:
did you add the tracking details to the item on Ebay? If they were there, and Ebay still found in buyer's favour on the basis of a not-received case where the item was received before judgement, then they have made an error. How you get that overturned is tricky, but I would start with a live chat.

More difficult if you didn't put the tracking details on the item.

I got to agree. given the amount of threads of late complaining about the scamming/problems etc it really is quite baffling how folks (and by that I mean those that read and post in these forums) continue to use ebay. either stop using the damn thing or just deal with it when it goes belly up. quit bellyaching! :p

Dont use paypal, put a disclaimer in the advert saying even tho paypal is a option i will not accept paypal as a method of payment and only BT or whatever else u think is ok to use. Then when the time comes to pay time for the seller send them a note about how to pay. Dunno if ebay likes this but meh fk em its ur item not theirs. If they kick a fuss say i told the buyer in the advert i wouldnt accept pp but a different means.

If the £70 is close to what you sold it for you could have sold it for just as much on the MM and avoided the associated fees. I don't really use eBay as much as I did unless I'm wanting more for something that people on here are willing to spend.

Even so, you shouldn't even have to plead a case if the buyer has signed for something. All these years dealing with the sale of items and the most basic protection still isn't enforced for sellers.

Buyer could have signed 'Micky mouse'with other hand and then could argue Hermes had delivered to incorrect address as they could prove it does not match anything else they have with a signature on.

I don't have the money, they've been refunded AND have the item.
MyHermes have confirmed the customer at that address signed for it. The buyer has asked if I can get the signature to see who signed for it...

Yeah I know I shouldve just used the MM... Lesson learnt!

Just gotta hope someone at PayPal sees sense or the buyer finds it in a drawer and sends the money... Both unlikely!

Did the buyer have decent feedback? If not next time state also in the advert a minimum feedback rating or no sale.

Problem is even if this guy does it all the time, the people he buys from (like op) can't even leave negative feedback, if he did have any negative feedback it could only be as a seller.

OP, while I understand your anger at eBay you have to accept a lot of the blame for this yourself. Let's look at the timescales involved here. I am making some assumptions based on this info, bear in mind if you had communicated with the buyer I am sure you would have mentioned it.

You sold a card but took 2-3 working days to post it. You used economy delivery with myhermes (not a great courier), with assumedly no tracking provided to the user and it took 5 working days to arrive. All in all from the time of paying the buyer waited over a week for his item. At no point do you state you kept the buyer in the loop, if you had I imagine you would not be in this situation.

  • Did you communicate that the parcel was posted?
  • Did you provide a tracking number?
  • Did you contact paypal with proof of delivery when you got it?

I mean you knew a case was opened against you, as soon as proof of delivery was obtained I would have contacted Paypal with the case number and sent them the proof of delivery. There is no way Paypal would have this info without you providing it to them. Had you done any of the above I imagine you would not be posting about your eBay woes. How would anyone feel as a buyer if they bought an expensive item and had not received it, or information on its whereabouts in a week.

As a seller on eBay I make sure that I send any expensive parcels using RMSD, that way I have peace of mind as a seller. I also ensure the items are posted within 1 working day and that the buyer is kept informed of tracking numbers etc.

You have enough proof to get Paypal to refund the money.
