Cancelled mobile phone contract

Hi, last week I canceled a mobile phone contract mid term and was quoted approximately £40 cancelation fee. I attempted to pay this over the phone but their systems were working correctly so I agreed for them to call me back.
A week later, they haven't called back but I have received an invoice for the cancelation fee but of about £200.
Can the company be held to the amount we agreed on the phone?

How much of the contract was left and what was the monthly cost?
Your cancellation fee will be your monthly cost - VAT * months remaining.
 
That sounds very low for a termination fee for any mobile contract unless you only had a couple of months left - they probably gave the wrong figure.

If you deciding to go ahead with the cancellation was based on the fee quoted, then you quite possibly could hold them to the £40 since I'm guessing you wouldn't have cancelled if they'd told you it would be £200?
 
Unless the £40 was per month remaining of contract either way unless you can prove what was said might struggle to get them to honour £40 price

If they have a recording of the call then that can be used as proof.

If they don't have a recording then they can't prove he requested the cancellation and he can just tell them he never requested it.

I think they may have meant that the fee to cancel is £40 on top of the remainder of the contract, as it seems way too low to terminate mid term.
 
Your termination is in the legal agreement you signed. Even if the person on the phone told you the wrong thing they have a legal contract with you which spells out your termination costs.

You can fight this but i absolutely guarantee you will lose.
