Harris Faulkner vs. Hasbro

I read the thread title as Harris Faulker vs Haribo.

I thought it was some kind of new sweets OCUK were shipping, its been a long day.

Have a go for the name maybe, but her likeness??!! Wtf? Resembles her appearance, eye shape and complexion??? Errrrrr.... Huh?

I can sort of relate to sharing the same name argument, but just lol at the line...

'bears a "physical resemblance" to her through its complexion, eye shape and eye makeup design, and poses a choking hazard to small children.'

. Come up with your own ideas.

They did, or does she make and sell toy hamsters with her name too?

Not exactly sure what the legalities are tbh, not using trademarks and brand names I can understand but names or stage names?

including complexion, eye shape and eye make-up design.

So the woman with brown skin, oval eyes and makeup like everyone else is complaining about the cream coloured toy with round eyes?

The name is the same, but so what, you have no right to have a unique name.

If I started selling sex toys named the "Boris Johnson" then I'd expect to get sued. I think it depends if people could reasonably conclude that the name means that you endorsed it.

But his hair is a major feature of his. This thing doesn't resemble her at all!

Plus I'm not entirely certain what a seasoned news anchor/journalist has in common with a plastic hamster?

Reuters quotes...

"Harris Faulkner, the uniquely named, acclaimed veteran journalist and author, has worked for decades to establish and maintain her personal brand and laudable professional reputation," only to suffer "substantial commercial and emotional damages" from Hasbro's conduct, the complaint said.'
