According to the law, yes it's an offence to do so.

I sort of get how the crime exists, I just can't understand how a bloke going 'I'm going to run through you like a freight train' and he/she sayingOK constitutes a crime. I mean if you've got to that stage then surely its not an issue lol

It's the deception part that's the crime. The logic is that you present yourself in a specific manner with the intention of a specific goal.

In the case of transgendered people, it's very possible that the other part wouldn't have been interested had the transgendered person been up front about the fact that they "used" to be a man/woman.

The billionaire one looks ridiculous because it's more based around someone's greed getting them in to such a situation. I highly doubt that in a court of law they would be handled in the same way though.

Because saying "I've got an Aston Martin" isn't really what's being discussed. There's more to it, for example if a woman was going on about how she just LOVES billionaires and she wants to leave with the next billionaire she sees.

If you go over and claim to be a billionaire and you leave together. Then it's been initiated on the premise of you being a billionaire.

It's not as simple as pretending to be wealthy to get women interested in you, then taking them back to a bedsit.

Yes, it was an extremely bad example. They were/are for all intents and purposes still a woman. The only difference is that they've had a double mastectomy and use testosterone to induce facial hair growth and other male physical traits.

It wasn't enough to stop their female functionality.

I don't really want to do this. I'm not qualified in either biology or psychology. However I also don't believe in simplistic models.

Our bodies and our minds are so inextricably tied together that attempting to say categorically "it's a choice" or "you're born with it" are both probably wrong statements. I would feel confident in saying that most people with "normal" /physical/ development have a pre-disposition toward the opposite sex. But also that life experiences, and brain chemistry anomalies (etc), can certainly change that outcome. As no doubt can mental disorders. Maybe even drugs. Or pollutants! Are the mental disorders in part caused by physical anomalies? Could be! Impossible for me to say.

Also do you define a gender based purely on genitalia?

In the vast majority of cases, I'd say that being born a woman with a healthy female body, hormones, brain chemistry (etc) makes you a woman.

I would, however, not select a partner from a genetic female who identified as a male. Neither would I ever select a partner who had been born a male.

Apparently the wording of the law is so vague that it would be entirely down to the jury to decide.

who said anything about a deciding factor, it was just curiosity. Barren woman still have the parts necessary for child birth though, they just can't have children for other reasons. was wondering if mtf were given those and whether ftm still have em

The law has always been clear that, unless there’s deception as to the nature of the act, or there is an impersonation of a known person, no amount of deception or fraud can turn otherwise consensual sex into rape.

So thats a no then, unless I claim to be someone famous, or trick her into sex for cash, cheers.
