I parked in this estate last night and received a £50 ticket this morning for parking in a private area..

But this is the half hidden sign which I failed to see last night

If you can be bothered to fight it there's a whole forum on how to on money-saving expert.

I think you've got a fair chance of not having to pay

Keep the photo and ignore the parking ticket.

They will have to demonstrate in court that you have caused £50 of financial loss (which they can't of course). Don't worry they won't actually take it that far.

Who issued the ticket ?

If it's the council you're screwed, if not there's a good chance you can contest it and win

As far as I am aware only parking tickets issued by the council are enforceable, any private tickets aren't. But this is only from what I've read online of course. It's their responsibility to ensure that all their signs are clearly visible.

Lol, looks like the residents themselves have been given a form to fill in by the housing association.

At least you aren't dealing with a parking enforcement company.

Wait to see if the bother getting the registered keeper's details and send a letter.

edit:

Actually this in Guernsey? Are the laws different?

If the was England, you could completely ignore it.

Ignore all advice in this thread, especially that from MrMoonX.

Hardly anyone appears to have noticed it's in Guernsey where the laws are different and therefore it's likely nobody here can offer anything meaningful. I've got no idea what a Terre L'Mende is and what jurisdiction the Royal Court who granted it have. It certainly sounds different the speculative invoices from private parking companies which people in England toss in the bin.

Amateur parking ticket = bin

Only ever pay if from council, no one else can fine you

Not the same for the Channel Isles iirc.

OP - get a free 30min consultaion with a local solicitor and see what they say.

I missed his location too :(

I used money saving experts to get out of mine in England.

Looks like the housing association has applied for Terre à l’amende

Terre à l’amende: Literally “penalty land”. An owner of land may apply to the Royal Court for permission, in effect, to declare his land penalty land. It gives him or her the right to issue what amounts to parking tickets for the sum of £50, enforceable by way of a petty debt court summons.

Which would suggest that unlike England, non-council bodies can issue penalty charge notices.

This would therefore mean that a formal appeal to the organisation on the grounds that the sign was obstructed by poorly maintained grounds is the only real option. But of course I am neither a lawyer nor a resident of Guernsey so who knows :D
